What is an Administrative Review Tribunal (ART) Appeal?

An Administrative Review Tribunal (ART) appeal is a legal process that lets eligible applicants seek an independent review of certain visa decisions made by the Department of Home Affairs. The Tribunal reassesses the facts and the law to decide whether the original decision should stand or be changed.

ART Appeal Process for Visa Decisions

1

Reviewing your visa refusal or cancellation decision

The process starts with a detailed review of the decision, to pin down the reasons for refusal or cancellation and check what review rights are available.

2

Lodging an appeal with the ART

An application for review needs to be lodged within the prescribed time limits and in line with Tribunal requirements.

3

Preparing legal submissions and supporting evidence

Thorough submissions and supporting documents are prepared to address the issues raised in the original decision.

4

Attending the tribunal hearing

You may be asked to attend a hearing, where the Tribunal looks at the evidence and may ask questions.

5

Tribunal decision and next steps

The Tribunal will hand down a decision, which may affirm, set aside, or remit the case, depending on the circumstances.

ART Appeal Deadlines and Time Limits

Time limits to lodge an ART appeal

Strict time limits apply, and they vary depending on the type of decision and your circumstances. For most onshore migration and protection decisions, the limit is 28 days from notification. Applicants in immigration detention generally have just 7 days, and Section 501 character decisions made in the migration zone carry an even shorter 9-day limit. Critically, for most migration and protection matters, the ART has no power to extend these deadlines, so missing one is usually final.

What happens if you miss the deadline

Missing the required timeframe can mean losing your review rights altogether, and for most migration and protection categories there's no ability to seek an extension, so there are very limited, if any, exceptions.

Factors affecting appeal timelines

How long an appeal takes can depend on how complex the case is, what evidence is available, and the Tribunal's current workload.

Documents Required for an ART Appeal

Visa refusal or cancellation notice

The original decision notice is essential for understanding the reasons behind the refusal or cancellation.

Supporting evidence addressing refusal reasons

Applicants should provide evidence that directly responds to the issues raised in the decision.

Personal statements and statutory declarations

Statements can help clarify circumstances and give the Tribunal extra context.

Additional documents strengthening your case

Further documentation may be needed to support claims and show eligibility.

What Happens During an ART Hearing?

How tribunal hearings are conducted

Hearings are usually held in a formal setting, where the Tribunal looks at the evidence and considers the submissions made.

Questions asked during the hearing

The Tribunal may ask questions to clarify parts of the application, the evidence, or your personal circumstances.

Role of migration lawyers during the hearing

Migration lawyers help by preparing clients, presenting legal arguments, and making sure procedural fairness is maintained throughout.

Possible Outcomes of an ART Appeal

Tribunal sets aside the Department's decision

The Tribunal may replace the original decision with a new one, which could be more favourable to the applicant.

Tribunal affirms the refusal decision

The Tribunal may agree with the Department's decision and uphold the refusal or cancellation.

Tribunal sends the case back for reconsideration

In some cases, the matter is sent back to the Department for reconsideration in line with the Tribunal's findings.

What If Your ART Appeal Is Unsuccessful?

Judicial review in the Federal Circuit and Federal Court

You may be able to seek judicial review if there's an arguable legal error in the Tribunal's decision.

Alternative visa pathways

Depending on your circumstances, other visa options may still be available.

Seeking further migration legal advice

Getting professional legal advice can help you identify the right next steps after an unsuccessful appeal.

Costs Involved in an ART Appeal

Administrative Review Tribunal application fees

You'll generally need to pay a Tribunal application fee to lodge an appeal, subject to any eligible fee reductions. As at 1 July 2026, the standard fee for review of a reviewable migration decision is $3,727. For protection-related decisions (Subclass 866 and Subclass 790), a separate fee of $2,293 generally applies, but this is usually only payable if the review is unsuccessful. A concessional fee of $100 applies in eligible circumstances, such as demonstrated financial hardship. The fee that applies depends on the date the fee is actually paid, not when the application is lodged.

Legal representation and preparation costs

Legal fees vary depending on how complex the case is and the level of representation needed.

Additional document preparation expenses

Costs can come up for gathering supporting evidence, translations, and other documentation.
