An Administrative Review Tribunal (ART) appeal is a legal process that lets eligible applicants seek an independent merits review of certain visa decisions made by the Department of Home Affairs. The ART was established under the Administrative Review Tribunal Act 2024 and replaced the former Administrative Appeals Tribunal (AAT) from 14 October 2024. In many cases, applicants have between 7 and 28 days from the date they're notified of the decision to lodge an appeal with the ART. A shorter, 9-day time limit applies specifically to Section 501 or 501CA character decisions where the person is in the migration zone, and the Tribunal has no power to extend this deadline under any circumstances.

Administrative Review Tribunal application fees

Effective from 1 July 2026, the ART filing fee is AUD $3,727 for most migration visa reviews, with a 50% reduction available in cases of financial hardship. Protection visa reviews don't require a fee at application stage, but a fee of AUD $2,293 becomes payable if the review is unsuccessful. Character-related refusals or cancellations are charged a lower standard fee of AUD $1,195, with a reduced fee of AUD $100 available in special circumstances.
