What is an Administrative Review Tribunal (ART) Appeal?

An Administrative Review Tribunal appeal is a legal process that allows eligible applicants to seek an independent merits review of certain visa decisions made by the Department of Home Affairs. The Tribunal reassesses the facts and law to determine whether the original decision should be upheld or changed. The ART was established under the Administrative Review Tribunal Act 2024 and began operating on 14 October 2024, when it replaced the AAT.

ART Appeal Deadlines and Time Limits

Time limits to lodge an ART appeal

Strict time limits apply to lodging an appeal, and these vary depending on the type of decision and the applicant's circumstances. In many cases, applicants have as little as 7 to 28 days from the date of notification to lodge an appeal. Some categories, such as certain onshore migration and protection decisions, carry a much shorter 9-day deadline, while other decision types allow up to 21 days, so it's important to confirm the exact deadline stated on your decision letter rather than assume a standard timeframe.

What happens if you miss the deadline

Failure to lodge an appeal within the required timeframe may result in the loss of review rights, with limited exceptions.

Factors affecting appeal timelines

The duration of an appeal can depend on case complexity, availability of evidence, and Tribunal workload.

The original decision notice is essential to understand the reasons for refusal or cancellation.

What Happens During an ART Hearing?

How tribunal hearings are conducted

Hearings are typically conducted in a formal setting, either as an oral hearing or, in some matters, decided as a paper review, where the Tribunal considers the evidence and submissions.

At an oral hearing, the Tribunal Member may ask questions to clarify aspects of the application, evidence, or personal circumstances.

Tribunal sets aside the Department's decision

The Tribunal may set aside the original decision and substitute a new, more favourable outcome. In other cases, rather than substituting its own decision, the Tribunal will remit the matter back to the Department for reconsideration in line with its findings.

Tribunal affirms the refusal decision

The Tribunal may agree with the Department's decision and uphold the refusal or cancellation.

Tribunal sends the case back for reconsideration

As above, in some cases the matter is remitted to the Department rather than decided directly by the Tribunal.

Applicants may have the option to seek judicial review where there's an arguable legal error in the Tribunal's decision.

Alternative visa pathways

Depending on individual circumstances, alternative visa options may be available.

Ministerial intervention in exceptional circumstances

In very limited circumstances, provisions such as Section 351 allow the Minister a personal, non-compellable power to substitute a more favourable decision where it's considered in the public interest. This power is discretionary and can't be requested as a matter of right.

Costs Involved in an ART Appeal

Administrative Review Tribunal application fees

As at 1 July 2026, the ART filing fee for a reviewable migration decision is $3,727, with a 50% reduction available for demonstrated financial hardship. A reviewable protection decision carries no fee to apply, with $2,293 payable only if the review is unsuccessful. Character-related refusals and cancellations carry a fee of $1,195, with a concessional fee of $100 available in eligible circumstances.
