Dependent Child Visa (Subclass 445): Bringing Your Child to Australia

The Subclass 445 Dependent Child visa gives a dependent child the right to live in Australia while their parent holds a temporary Partner visa and waits for the permanent Partner visa decision. The child's lawful status under this visa runs in step with the parent's partner visa journey, and the decisions made during that process have a direct bearing on the child's continued right to remain in Australia.

What Is the Dependent Child Visa (Subclass 445)?

Woman and children looking out of an airport window

The Subclass 445 is a temporary visa created for dependent children of people who hold a temporary Partner visa. Because the Partner visa process involves a temporary stage that can last several years before the permanent stage is decided, the 445 gives a dependent child a lawful and practical way to be in Australia throughout that waiting period rather than having to leave and reapply under a different pathway.

A child granted the Subclass 445 can live in Australia, undertake study at any level of education, engage in paid work without restriction, and travel internationally and return to Australia while the visa remains in effect. These entitlements continue until the parent's permanent Partner visa is decided, at which point the 445 ceases automatically.

The 445 sits within one of two permanent Partner visa pathways depending on the parent's situation. Where the parent entered Australia on a Subclass 309 (Partner, offshore) and is awaiting the Subclass 100 (Partner, permanent) decision, the child's 445 is tied to that pathway. Where the parent is in Australia on a Subclass 820 (Partner, onshore) awaiting the Subclass 801 (Partner, permanent) decision, the child's 445 connects to that pathway instead.

Who Is Eligible for the Subclass 445 Visa?

All of the following conditions must be satisfied for a child to qualify for the Subclass 445.

The Parent Must Currently Hold an Eligible Visa

At both the time of application and the time of decision, the parent must hold a Subclass 309, Subclass 820, or Subclass 445 visa. A parent whose partner visa has already progressed to the permanent stage or whose temporary partner visa has been refused is not in a position to sponsor a child for a 445 visa.

The Child Must Be a Dependent Child

The child must be a biological child, adopted child, or step-child of the parent who holds the eligible partner visa or of the sponsor. The child must not be married, engaged to be married, or in a de facto relationship at the time of application or decision. These conditions apply regardless of the child's age.

Age and Financial Dependency

A child who is under 18 at the time of application meets the age component of eligibility automatically, provided the other conditions are satisfied. A child who is 18 or older must go further and demonstrate that they are genuinely financially dependent on the parent for their basic living needs. A child in that age group who has their own income, employment, or means of financial support will generally not satisfy this requirement.

Yêu cầu về sức khỏe và tính cách

Every applicant for the Subclass 445 must satisfy the health requirement, which involves a medical examination conducted by a panel physician approved by the Department of Home Affairs. The character requirement also applies. Depending on the child's age and the countries in which they have lived, this may require police clearance certificates from relevant jurisdictions.

Sponsorship Requirements

The person who sponsors the child's 445 visa application must be the same Australian citizen, Australian permanent resident, or eligible New Zealand citizen who sponsored the parent's Partner visa. A different sponsor cannot be substituted. Sponsor approval by the Department of Home Affairs is required before the 445 visa can be granted, and that assessment includes consideration of the best interests of the child under the current applicable Ministerial Direction.

Proving Financial Dependency for Children Aged 18 and Over

Where a child is 18 or older, establishing financial dependency is the central eligibility question and the standard of documentary evidence required is meaningful. A general statement that the parent supports the child is not sufficient on its own.

Relevant evidence includes documentation showing the child resides with or is directly supported by the parent, records of the parent meeting the child's accommodation, food, and everyday living costs, bank records showing a consistent pattern of financial transfers from the parent to the child, and where the child is in full-time study, enrolment confirmation and evidence that the child is not in employment that provides financial self-sufficiency. The Department of Home Affairs assesses this evidence as a whole, looking for a coherent and credible picture of genuine ongoing financial reliance.

Onshore vs Offshore Subclass 445 Applications

The Subclass 445 can be applied for whether the child is in Australia or outside Australia at the time of lodgement. It can also be granted to a child in either location. There is no requirement for the child to be onshore or offshore at any particular point in the process, which gives the 445 a degree of flexibility that some other visa subclasses do not offer.

This distinguishes the 445 from two other child visa subclasses that cover related but distinct circumstances. The Subclass 101 (Child visa) is an offshore visa for children in a broader range of family circumstances not specific to the temporary partner visa context. The Subclass 802 (Child visa) is the onshore equivalent in that broader context. The 445 applies specifically where the parent holds a temporary partner visa and the child's application is anchored to that parent's partner visa journey.

Where there is any uncertainty about which visa pathway applies to a child's particular circumstances, legal advice should be obtained before an application is lodged.

How to Apply for the Subclass 445 Visa

  1. Step 1 Confirm the Parent's Visa Status and Sponsor Details

Before preparing the application, verify that the parent currently holds a Subclass 309, 820, or 445 visa and confirm that the person who sponsored the parent's partner visa is willing and able to sponsor the child's 445 application.

  2. Step 2 Gather All Supporting Documents

Collect every document required to support the application before lodging. Incomplete applications create delays and frequently result in requests for further information that extend processing considerably. The documents checklist is set out in detail below.

  3. Step 3 Lodge a Paper Application With the Child and Other Family Processing Centre

The Subclass 445 is not available for online lodgement through ImmiAccount. It requires a paper application submitted to the Department of Home Affairs' Child and Other Family Processing Centre. The correct application form and current lodgement address are published on the Department of Home Affairs' official website. Confirm the current lodgement address at the time of submission as processing arrangements may change.

  4. Step 4 Complete Health and Character Checks

Following lodgement, health examinations are arranged through a panel physician approved by the Department of Home Affairs. Where police clearance certificates are required, these must be obtained from each relevant jurisdiction. Delays in completing health or character requirements are among the most common reasons 445 applications take longer than expected.

  5. Step 5 Respond to Any Requests and Await Decision

The Department may request additional information or documents during the assessment. Responding promptly and completely to any such requests helps avoid unnecessary delays in reaching a decision.

Subclass 445 Documents Checklist

Identity and Relationship Documents

  • The child's birth certificate confirming their relationship to the parent holding the eligible Partner visa.
  • The child's current passport and any previous passports held.
  • The parent's visa grant notice confirming they currently hold a Subclass 309, 820, or 445 visa.

Custody and Consent Documents

  • Where the child is not in the sole custody of the applying parent, written consent from the other parent confirming they agree to the child travelling to and living in Australia, or a court order establishing that the applying parent has sole custody. This requirement is one of the most frequently overlooked aspects of a 445 application and its absence routinely causes significant delay.
  • Where the other parent is deceased, documentary evidence of that parent's death.

Tài liệu của nhà tài trợ

  • The completed sponsor nomination form with the sponsor's personal details and confirmation of their agreement to sponsor the child.
  • Evidence confirming that the sponsor is the same person who sponsored the parent's Partner visa.

Dependency Evidence for Children Aged 18 and Over

  • Bank records showing a consistent pattern of financial support from the parent to the child.
  • Evidence of the child's living arrangements showing they reside with or are supported by the parent.
  • Enrolment confirmation for full-time study where the child is in education.
  • Any other documentation that substantiates the claim of genuine financial dependency.

Các tài liệu về sức khỏe và phẩm chất

  • Medical examination results from an approved panel physician.
  • Police clearance certificates from each country where the child has lived for the relevant period, where required by the Department of Home Affairs based on the child's age and history.

Certified Translations

  • Certified translations prepared by a qualified translator for any document not originally issued in English, submitted alongside the original document.

Subclass 445 Visa Processing Times

The Department of Home Affairs does not publish a fixed processing timeframe for the Subclass 445 visa. The time taken to reach a decision varies from application to application.

The factors that most commonly affect processing time are how complete the application is at the point of lodgement, how quickly health examinations are completed and results received by the Department, whether custody and consent documentation is straightforward or raises questions that require further enquiry, and whether the sponsor assessment process identifies any matters requiring additional consideration.

Subclass 445 Visa Cost

The visa application charge for the Subclass 445 Dependent Child visa is set by the Department of Home Affairs and is reviewed annually, with changes typically taking effect on 1 July each year. The current charges effective 1 July 2026 are as follows:

ĐơnCharge
Người nộp đơn chínhAUD 4,040
Additional applicant aged 18 or overAUD 2,020
Người nộp đơn bổ sung dưới 18 tuổiAUD 1,015

In addition to the visa application charge, applicants should budget for health examination costs, police clearance certificates where required, and certified translations for documents not issued in English.

From the Subclass 445 Visa to Permanent Residency

The Subclass 445 is temporary and ceases at the moment the parent's permanent Partner visa is decided. To secure the child's continued right to live in Australia beyond that point, the child must be formally added to the parent's permanent Partner visa application before the Department of Home Affairs makes its decision on that visa.

The mechanism for doing this is Form 1002 (Request to add a dependent child to an existing application). Form 1002 must be lodged with the Department before the permanent Partner visa decision is made. If the permanent visa is decided before the Department has received and registered the request to include the child, the child cannot be added to that visa. At that point, alternative visa options must be explored, none of which replicate the straightforward pathway that the 445 provided.

The specific steps depend on the parent's visa pathway:

Where the parent holds a Subclass 309 and the child holds a Subclass 445, the child must be added to the Subclass 100 application before the Subclass 100 decision is made.

Where the parent holds a Subclass 820 and the child holds a Subclass 445, the child must be added to the Subclass 801 application before the Subclass 801 decision is made.

Keeping track of where the parent's permanent partner visa application is in the queue and submitting Form 1002 well ahead of the anticipated decision date is one of the most important practical steps in the entire 445 process. The consequences of missing the window are significant and cannot be corrected after the fact.

Common Subclass 445 Visa Mistakes

  • Applying After the Parent's Permanent Partner Visa Has Been Decided

The Subclass 445 is only available while the parent holds a Subclass 309, 820, or 445. Once the parent's permanent Partner visa has been decided, whether granted or refused, the 445 pathway closes. An application lodged after that point cannot succeed, and the child must pursue a different visa pathway.

  • Overlooking the Other Parent's Consent

In applications where the child is not in the sole custody of the parent holding the Partner visa, written consent from the other parent is a mandatory requirement. Applications submitted without this consent, or without a valid court order demonstrating sole custody, will stall and may be refused. Identifying and addressing this requirement at the earliest stage of preparation avoids a preventable and potentially serious delay.

  • Nominating a Different Sponsor

The sponsorship requirement is specific: the sponsor must be the same individual who sponsored the parent's Partner visa. Submitting an application with a different sponsor does not satisfy the requirement and the application will not succeed on that basis.

  • Weak Dependency Evidence for Children Aged 18 and Over

Applications for children aged 18 or older that rely on general assertions of parental support without documentary evidence are a consistent cause of requests for further information and, in some cases, refusal. The Department of Home Affairs requires concrete evidence of ongoing financial dependency, not a statement that support exists.

  • Not Adding the Child to the Permanent Partner Visa Application in Time

A 445 visa that has been properly obtained and maintained provides no ongoing protection after the parent's permanent Partner visa is decided if the child has not been added to that application. This single administrative oversight, which is entirely preventable, is among the most consequential errors in the 445 process. No discretion exists to remedy it after the permanent visa decision has been made.

What If the Parent's Partner Visa Is Refused?

Because the Subclass 445 is tied to the parent's partner visa, a refusal of that visa has direct consequences for the child.

  1. If the parent's partner visa is refused and that refusal is not overturned, the child's 445 visa ceases. The child must either depart Australia or secure a different basis for lawful stay before the 445 ends.

  2. Where the parent is onshore and seeks merits review of the refusal at the Administrative Review Tribunal, the parent is generally entitled to a bridging visa that allows them to remain in Australia while the review proceeds. The child's position during that period depends on their specific circumstances and what visa conditions apply. Offshore applicants refused a partner visa do not receive a bridging visa and generally do not have access to merits review at the Tribunal.

  3. If the parent's refusal is overturned at review and the partner visa is subsequently granted, the child's pathway can continue as planned. Acting promptly after a refusal is received, including immediately assessing whether review rights exist and what the review timeframes are, is critical given the direct impact on the child.

We assess whether the child meets the conditions for the Subclass 445, including the financial dependency requirement for children aged 18 and over, and advise on how to present the application in the strongest possible way.

Custody and Consent Strategy

We advise on how to satisfy the custody and consent requirements, including in circumstances where the other parent is uncooperative, has not been in contact, or cannot be located.

Application Preparation

We prepare the complete Subclass 445 application including all required forms, supporting documents, and evidence, and manage lodgement with the Child and Other Family Processing Centre.

Frequently Asked Questions About the Subclass 445 Visa

Who can apply for the Subclass 445 visa?

A dependent child can apply for the Subclass 445 where their parent currently holds a Subclass 309, 820, or 445 visa. The child must not be married, engaged, or in a de facto relationship. Children under 18 satisfy the age component automatically. Children aged 18 and over must demonstrate genuine financial dependency on the parent.

What happens to my child's 445 visa if my Partner visa is refused?

If your Partner visa is refused and the refusal is not overturned, your child's 445 visa ceases. If you are onshore and apply to the Administrative Review Tribunal for a review of the refusal, you are generally entitled to a bridging visa while the review proceeds, but your child's position during that period depends on their individual circumstances. Legal advice should be sought as soon as a refusal is received.

Is there an age limit for the Subclass 445 visa?

There is no hard upper age limit, but children aged 18 and over must be able to demonstrate that they are financially dependent on the parent for their basic needs. A child who is financially self-sufficient will not meet this requirement regardless of their age.

How long does the Subclass 445 visa take to process?

The Department of Home Affairs does not publish a fixed processing timeframe for this visa. Processing times depend on the completeness of the application, the time taken to complete health and character checks, and whether any questions arise from custody or consent documentation. Contact our migration lawyers for guidance on current processing times.

How much does the Subclass 445 visa cost?

The current visa application charges effective 1 July 2026 are set out in the cost section above. Additional costs include health examinations, police clearance certificates where required, and certified translations for documents not issued in English. Contact our migration lawyers for guidance on total costs for your situation.

How do I add my child to my permanent Partner visa?

You must lodge Form 1002 with the Department of Home Affairs before your permanent Partner visa is decided. If the permanent visa is decided before the Department receives and registers your request to include the child, the child cannot be added to that visa. This step should be taken well before the anticipated decision date.

Can my child work and study on a Subclass 445 visa?

Yes. A child holding a Subclass 445 visa can study at any level of education, engage in paid employment without restriction, and travel internationally and return to Australia while the visa remains in effect.

Can I apply for a Subclass 445 visa while in Australia?

Yes. The Subclass 445 can be applied for and granted to a child who is in Australia or outside Australia at the time of application and at the time of decision.
