Những điểm chính cần lưu ý

  • From 12 November 2026, all Subclass 407 Training visa applicants must be outside Australia when lodging their application and when the visa is granted. Onshore lodgements will be treated as invalid.
  • An invalid application does not trigger a Bridging visa and cannot be appealed to the Administrative Review Tribunal (ART), meaning applicants risk becoming unlawful if they attempt to lodge onshore after the cut-off date.
  • Concurrent lodgement is no longer permitted. A sponsoring organisation must hold approved Temporary Activities Sponsor status and have its nomination formally approved by the Department of Home Affairs before a visa application can be validly submitted.
  • Applications validly lodged prior to 12 November 2026 will continue to be assessed under the rules in place at the time of lodgement.
  • The Subclass 407 visa is designed exclusively for genuine occupational training. It is not intended as an alternative to Temporary Skilled Work visas or as a means of addressing general labour shortages.
  • Sponsors and prospective applicants should seek legal advice now to assess program eligibility, training plan compliance, and offshore lodgement timing ahead of the November deadline.
phút đọc

From 12 November 2026, there are new rules that affect where applicants can apply and be granted a Training visa (subclass 407). These incoming changes to Australia's Subclass 407 Training visa framework have introduced important new requirements for employers, sponsors and prospective applicants. The reforms affect how training programs must be structured and when key sponsorship and nomination steps need to be completed.

The changes reflect the Australian Government's focus on strengthening the integrity of the Training visa program and ensuring it is used for genuine occupational training rather than as an alternative pathway to ongoing employment.

This update sets out the major changes to the Subclass 407 application process and provides detail about what the changes mean for prospective applicants, sponsoring organisations and some of the practical implications to consider when preparing a Subclass 407 application.

Key Policy Changes to the Subclass 407 Training Visa

The Department of Home Affairs has implemented two largel shifts in the administration of the Subclass 407 Training visa:

1. Mandatory Offshore Lodgement and Grant (Effective 12 November 2026)

As from 12 November 2026, all applicants for a subclass 407 training visa are required to be outside of Australia when lodging their application for this visa and also when granted the visa.

This will mean that, from 12 November 2026:

  • Onshore lodgements will no longer be permitted. If an applicant lodges an application while in Australia on or after 12 November 2026, the application will be deemed invalid.
  • An invalid application does not trigger a Bridging visa and cannot be appealed to the Administrative Review Tribunal (ART).
  • Attempting to lodge onshore may cause applicants to become unlawful or compromise their ongoing immigration status.
  • Applications validly submitted prior to 12 November 2026 will continue to be assessed under the regulations in place at the time of lodgement.

2. Sequential Processing and Approved Nomination Pre-Condition

This offshore requirement builds upon earlier amendments under the Migration Regulations 1994, which eliminated the practice of concurrent (simultaneous) lodgements. Prospective trainees can no longer lodge a visa application while a nomination remains pending.

Before any visa application can be lodged:

  • The organisation must already hold approval as a Temporary Activities Sponsor.
  • The specific nomination program must be formally approved by the Department of Home Affairs (unless the sponsor is an Australian Commonwealth Government agency).

Purpose and Eligibility Under the Subclass 407 Visa

The Subclass 407 is a temporary visa for foreign workers that allows them to engage in occupational workplace-based training activities in Australia for no longer than 2 years. The Subclass 407 visa has been created specifically for enhancing an individual's skill level, registering as a professional and developing their capacity and not for replacing Temporary Skilled Work Visas or addressing General Labour Shortages.

To qualify under the three recognised training streams, applicants must fall within one of the following nomination pathways:

  • Occupational training required for registration: Training necessary to obtain registration, membership, or licensing required to practise in Australia or in the applicant’s home country.
  • Occupational training to improve skills in an eligible occupation: Structured, workplace-based training tailored to an eligible skilled occupation for individuals with recent qualifying work or study experience.
  • Occupational training for capacity building overseas: Structured training for overseas qualification completion, government-supported programs, or senior professional development initiatives.

In addition to meeting stream-specific benchmarks, nominees must satisfy standard legislative criteria, including functional English, adequate health insurance, and public interest criteria encompassing health and character.

Strategic Implications for Sponsors and Trainees

The shift to mandatory offshore applications and sequential nomination approvals demands careful strategic planning.

Elimination of Onshore Bridging Visa Strategies

Onshore Bridging strategies were previously employed by graduate visa holders and temporary visa holders in the same way as onshore transitions. The elimination of these Bridging strategies from 12 November 2026 means that prospective trainee visa applicants who have finished an existing temporary visa will need to ensure they leave Australia and lodge an offshore application prior to receiving a positive Training nomination.

Heightened Scrutiny on Training Plans and Remuneration

The Department of Home Affairs continues to intensify review standards for occupational training nominations. Officers closely examine whether training plans reflect genuine skill progression or disguise ordinary employment. Ensuring that the curriculum is comprehensive, that trainers are adequately qualified, and that remuneration complies with national workplace relations laws, such as Fair Work Ombudsman standards is essential.

Preparing decision-ready applications from the outset is vital to reduce delays and mitigate the risk of adverse outcomes.

Những câu hỏi thường gặp

Can I apply for a Subclass 407 Training visa while onshore in Australia after 12 November 2026?

No. From 12 November 2026, you must be physically outside Australia when you submit your application and when the Department of Home Affairs makes a decision. Applications lodged onshore on or after this date will be treated as invalid, meaning they will not be assessed and cannot grant you a Bridging visa.

Can my sponsor lodge my nomination and visa application at the same time?

No. Under current rules, concurrent lodgement is no longer permitted. Your sponsoring organisation must hold approved Temporary Activities Sponsor status and have its specific nomination approved by the Department of Home Affairs before your visa application can be validly submitted.

What happens to Subclass 407 visa applications lodged before 12 November 2026?

All valid visa applications that were lodged prior to 12 November 2026 will be assessed against the rules that were in place at the time of their submission. Therefore, if you have validly lodged your visa application onshore before the cut-off date of 12 November 2026, your application will continue to be processed with current rules in place.
