A Protection Visa lets people who meet Australia's refugee or complementary protection criteria remain in Australia lawfully. It's generally granted to those who can't safely return home because of a well-founded fear of persecution or serious harm. Depending on the subclass and the individual's circumstances, it can lead to a lawful stay or, in some cases, permanent residency.
We provide sensitive, confidential legal help to people seeking asylum in Australia. This covers preparing protection claims, gathering country evidence, and structuring a personal statement in line with legal requirements. We also help respond to Departmental requests, prepare for interviews, and work through anything that could affect the strength of an application or how credibility is assessed.

Fear of persecution in your home country
Risk of serious harm or human rights violations
Refugee status requirements under Australian law
Meeting health and character requirements
Passport or identity documents
Identity documents help establish nationality and background, though alternative evidence can be used if official documents aren't available.
Evidence supporting your protection claims
This can include personal accounts, incident records, threats, or other documentation that supports the claimed fear of harm.
Personal statements and statutory declarations
A detailed written statement setting out your experiences, fears, and reasons for seeking protection is essential.
Country condition evidence and reports
Independent reports on conditions in your home country help support claims of risk or persecution.
Supporting documents from witnesses or organisations
Statements from witnesses, community organisations, or professionals can add weight to an application.
We look at your situation, walk through the eligibility criteria, and get a sense of how strong your protection claim is.
We help prepare your written claims, gather supporting documents, and structure your case in line with legal requirements.
We make sure your application is submitted correctly, with all the required evidence and supporting materials.
You may need to attend an interview where your claims are assessed. We help you prepare for the questions and understand what to expect.
If refused, you may be able to seek merits review at the ART, where your case is reassessed against the evidence and the law.
In some cases, a legal error in how the decision was made may allow for judicial review in the Federal Circuit and Federal Court.
We help with complex matters involving credibility concerns, adverse security findings, or previous refusals.
A protection visa application calls for careful legal and factual preparation. A lawyer can help structure your claims clearly, make sure your evidence meets what's legally required, and work through credibility issues that may come up during assessment. Legal representation can also help reduce the risk of refusal linked to incomplete or inconsistent information, and helps make sure you're properly prepared for interviews and appeals.
Government protection visa application fees
A Protection Visa (Subclass 866) application generally carries a modest government charge of around $50, applying to all family members included in the same application.
Legal representation and consultation costs
Legal fees depend on how complex your case is, what evidence is needed, and whether an appeal is involved.
Translation and document preparation costs
Extra costs can include certified translations, country reports, and preparing supporting documents.
Factors affecting protection visa processing times
Processing time depends on how complex the case is, how complete the evidence is, whether an interview is needed, and any security or character checks required.
Typical processing timelines for Subclass 866 applications
Processing can take anywhere from several months to over a year, depending on workload and individual circumstances.
Employer not meeting sponsorship requirements
An application can be refused if the employer doesn't meet its legal sponsorship obligations or fails a compliance check.
Insufficient evidence supporting the protection claim
An application may be refused if there isn't enough credible evidence to support the claimed risk.
Failure to meet refugee or complementary protection criteria
Applicants need to meet the strict legal definitions set out under Australian migration law.
Incorrect or incomplete documentation
Documents that are missing or poorly prepared can significantly weaken an application.
Sydney has an established network of migration and refugee lawyers who regularly work on protection visa applications, refusals, and appeals. This includes support with preparing detailed statutory declarations, gathering country condition evidence, and representing applicants at interviews and tribunal hearings. Getting early legal advice can matter a great deal in protection matters, where credibility and supporting evidence are closely examined.
A number of community and support organisations in Sydney assist asylum seekers and protection visa applicants. These can include legal aid services, refugee advocacy groups, and settlement support organisations that help with practical needs like referrals, documentation support, and navigating the visa process. These services can matter a great deal for people who are newly arrived or in a vulnerable position.
Sydney offers a wide range of settlement support services, covering healthcare, education, housing assistance, and employment support programs. For people seeking protection, these services can play an important role in building stability while a visa application or appeal is being assessed. Sydney's established multicultural communities also provide added social and practical support during settlement.
Experienced migration lawyers handling protection visa cases
Our lawyers have worked on a wide range of protection visa matters, including refugee claims, complementary protection applications, and complex refusal cases. We understand how the Department approaches protection claims, including credibility, evidence requirements, and country information analysis, which lets us give guidance suited to your individual circumstances.
Strategic legal representation for asylum claims
A protection visa application needs a carefully structured legal approach. We help prepare detailed written claims, organise supporting evidence, and work through potential weaknesses in a case before it's submitted. Where needed, we also help clients prepare for interviews and tribunal hearings, so the claim is presented clearly and consistently at every stage.
Strong track record in protection visa applications and appeals
We've worked with clients across initial applications, Administrative Review Tribunal (ART) reviews, and judicial review matters where a legal error is alleged. Our focus is on identifying the strongest legal and factual arguments available in each case and building a submission that's properly supported.
Compassionate and confidential legal support
Protection visa matters often involve sensitive, deeply personal circumstances. Every matter is handled with strict confidentiality and care. We aim for clear, respectful communication and support throughout, so you're kept informed at every stage of your application or appeal.
