Strict time limits apply, and they vary depending on the type of decision and your circumstances. For most onshore migration and protection decisions, the limit is 28 days from notification. Applicants in immigration detention generally have just 7 days, and Section 501 character decisions made in the migration zone carry an even shorter 9-day limit. Critically, for most migration and protection matters, the ART has no power to extend these deadlines, so missing one is usually final.

Missing the required timeframe can mean losing your review rights altogether, and for most migration and protection categories there's no ability to seek an extension, so there are very limited, if any, exceptions.

Administrative Review Tribunal application fees

You'll generally need to pay a Tribunal application fee to lodge an appeal, subject to any eligible fee reductions. As at 1 July 2026, the standard fee for review of a reviewable migration decision is $3,727. For protection-related decisions (Subclass 866 and Subclass 790), a separate fee of $2,293 generally applies, but this is usually only payable if the review is unsuccessful. A concessional fee of $100 applies in eligible circumstances, such as demonstrated financial hardship. The fee that applies depends on the date the fee is actually paid, not when the application is lodged.
