When your visa is refused by the Department of Home Affairs, you'll receive a written decision under Section 65 of the Migration Act outlining the reasons for refusal and whether you have the right to seek review. In many cases, you may be eligible to appeal the decision through the Administrative Review Tribunal (ART).
Depending on your circumstances, strict deadlines apply, often ranging from a few days to several weeks. Acting quickly matters, since it helps preserve your review rights and avoid losing the opportunity to appeal.
Failure to meet visa eligibility requirements
Applications may be refused if you don't satisfy the specific criteria for the visa subclass you applied for.
Insufficient supporting documents
Missing or incomplete evidence is one of the most common reasons for refusal.
Incorrect or misleading information
Errors, inconsistencies, or unintentional misstatements can significantly affect the outcome of your application.
English language or financial requirements
Failing to meet minimum language or financial thresholds may result in refusal.
Character or health concerns
Applicants must satisfy Australia's character and health requirements, and failing to do so can lead to refusal.
We begin with a detailed review of your refusal notice and the Department's reasoning, identifying factual findings, legal criteria applied, and any potential errors in how your application was assessed.
Not every refusal can be appealed. We assess whether you have valid review rights, which tribunal has jurisdiction, and whether strict filing deadlines apply, and whether an appeal, re-application, or alternative visa pathway suits your circumstances best.
If you're eligible, we prepare and lodge your application within the required timeframe, making sure all procedural requirements are met at the time of filing.
We develop a structured legal strategy supported by detailed written submissions, statutory declarations, and documentary evidence.
Your case is then listed for a tribunal hearing, where a member of the ART reviews the evidence and may ask questions. A written decision is then issued affirming, varying, or overturning the original refusal.
The ART is an independent body that conducts merits review of migration decisions, reviewing certain visa refusal decisions made by the Department of Home Affairs. It doesn't act on behalf of the Department and is required to make a fresh decision based on the evidence and the law.
Only applicants whose refusal is a reviewable migration decision, meaning it carries valid merits review rights under the Migration Act, can apply. Eligibility depends on factors such as visa subclass, location at the time of refusal, and sponsorship arrangements. We assess these factors to confirm whether an appeal is legally available. Some decisions fall outside the ART's jurisdiction entirely, particularly a non-reviewable decision the Minister makes personally rather than through a delegate.
Tribunal hearings are more informal than court proceedings but still legally structured. You may be required to answer questions about your application, provide clarification on evidence, and respond to concerns raised by the Tribunal member.

rict deadlines apply depending on your visa type and location at the time of refusal. In many cases, you may only have a short bridging visa appeal period, often between 7 and 28 days, to lodge an appeal with the ART. The ART generally can't extend this filing deadline for migration or protection matters, even in compelling circumstances, so a time limit extension shouldn't be assumed to be available.
Tribunal processing times can vary significantly depending on complexity and workload, commonly ranging from several months to over a year.
ART application fees
As at 1 July 2026, the ART application fee for migration matters is $3,727, with a $2,293 fee for protection matters and a $100 concessional fee available in limited circumstances, including on grounds of financial hardship.
Legal representation and consultation costs
Legal fees vary depending on case complexity and the level of representation required.
Additional document preparation expenses
Costs may include translation, expert reports, or supporting evidence preparation.
The Tribunal may set aside the refusal and substitute a positive decision, or remit the matter for reconsideration. An ART set aside decision means the original refusal no longer stands, and the matter is either decided afresh by the Tribunal or sent back to the Department.
In some cases, your application is sent back to the Department for final processing.
You may proceed with visa grant conditions or further documentation requests.
You may be able to challenge legal errors in the decision through court review.
Other visa options may still be available depending on your circumstances.
