Time limits to lodge an ART appeal
Strict time limits apply to lodging an appeal, and these vary depending on the type of decision and the applicant’s circumstances. For most onshore migration and protection decisions, the limit is 28 days from notification. Applicants in immigration detention generally have just 7 days, and Section 501 character decisions made in the migration zone carry an even shorter 9-day limit. For most migration and protection matters, the ART has no power to extend these deadlines, so missing one is usually final.

Failure to lodge an appeal within the required timeframe may result in the loss of review rights, with limited exceptions.

Costs Involved in an ART Appeal

Administrative Review Tribunal application fees

Applicants are required to pay a Tribunal application fee when lodging an appeal, subject to eligibility for any fee reductions. As at 1 July 2026, the standard fee for a reviewable migration decision is $3,727. A separate fee of $2,293 applies for protection-related decisions, generally payable only if the review is unsuccessful. A concessional fee of $100 applies in eligible circumstances.
