重點摘要

  • A visitor visa does not lead directly to permanent residency.
  • From 17 September 2026, the government has announced that Condition 8503 will be applied to all visitor visas, which would require most holders to leave Australia to apply for another visa.
  • Condition 8503 currently blocks most onshore applications unless a waiver is granted.
  • A waiver requires compelling and compassionate circumstances beyond your control that arose after the visa was granted.
  • Visa application charges for the Subclass 600 increased from 1 July 2026.
  • Many permanent visas can be applied for from outside Australia.

Many people arrive in Australia on a visitor visa and, during their stay, begin to consider whether they could build a permanent future here. Some meet a partner, some receive interest from an employer, and others simply decide that Australia is where they want to live. Moving from a visitor visa to permanent residency is possible in some circumstances, but there is no direct pathway, and the conditions attached to your visa can determine whether you are able to apply from within Australia at all.

This article explains how a visitor visa interacts with permanent visa options, the effect of the No Further Stay condition, the pathways most considered by visitor visa holders, and the key changes to visitor visas announced in 2026.

What a Visitor Visa Allows and What It Does Not

The Visitor visa (Subclass 600) is a temporary visa for tourism, visiting family and friends, or business visitor activities, generally granted for stays of up to three, six or 12 months. Under Schedule 2 of the Migration Regulations 1994, applicants must genuinely intend to stay in Australia temporarily. The visa does not permit work, and it may carry conditions such as Condition 8101 (no work), Condition 8201 (study or training limited to three months) and Condition 8558 (no more than 12 months' stay in any 18-month period).

Because the visa is temporary by design, there is no process to convert a tourist visa to permanent residency in Australia. A person seeking permanent residency must separately apply for, and satisfy every criterion of, a permanent or provisional visa. Information given in a visitor visa application must also be accurate. Where the Department of Home Affairs finds that false or misleading information was provided, Public Interest Criterion 4020 can lead to refusal and, in some cases, an exclusion period affecting future applications.

Changes to the Visitor Visa (Subclass 600) in 2026

Two changes affecting the Visitor visa (Subclass 600) took effect on 1 July 2026, and a further change has since been announced.

Increased Application Charges From 1 July 2026

The government increased visa application charges across most subclasses from 1 July 2026, under the Home Affairs Legislation Amendment (2026 Measures No. 1) Regulations 2026. For the Subclass 600, the changes are:

  • Tourist stream (offshore): $200 increased to $250
  • Tourist stream (onshore): $500 increased to $630
  • Frequent Traveller stream: increased to $1,845
  • Business Visitor, Sponsored Family and Approved Destination Status streams: increased to $250

The new charges apply to applications lodged on or after 1 July 2026. Applications lodged before that date are assessed under the previous fee schedule, regardless of when a decision is made.

Announced Change: No Further Stay Condition to Apply to All Visitor Visas

On 17 September 2026, the Minister for Home Affairs announced that the government intends to apply Condition 8503 to all Visitor visa (Subclass 600) grants. Currently, Condition 8503 is commonly imposed on Sponsored Family stream visitor visas and at the decision maker's discretion on other streams, but it is not automatically applied to every Subclass 600 grant.

If implemented, this change would mean that most visitor visa holders would be required to leave Australia to apply for another visa, rather than being able to do so onshore. The announcement is aimed at stopping visitor visa holders from switching to a bridging visa or other pathway to extend their stay in Australia.

This measure has been announced but has not yet commenced. The Department of Home Affairs has not published the legislative instrument needed to give it effect, and the precise scope of any exceptions has not been confirmed. Visitor visa holders who are considering an onshore application should not assume this change is already in force but should seek advice promptly given how quickly policy in this area is moving.

Condition 8503: The No Further Stay Condition

Condition 8503 is set out in Schedule 8 of the Migration Regulations 1994. It provides that the visa holder will not, after entering Australia, be entitled to be granted most substantive visas while they remain in Australia. In practical terms, a visitor visa holder subject to this condition generally cannot make a valid onshore application for a partner, skilled, student or further visitor visa.

The condition is commonly imposed on Sponsored Family stream visitor visas and may be imposed on other streams at the decision maker's discretion. The visa grant notice will list any conditions, and you can also confirm them through Visa Entitlement Verification Online (VEVO). Checking this is an essential first step before making any plans. As noted above, the government has announced that Condition 8503 will be applied to all visitor visa grants once the relevant legislative instrument is in place.

Condition 8503 Waiver Requirements

The Minister, through the Department of Home Affairs, may waive Condition 8503 in limited circumstances under section 41(2A) of the Migration Act 1958. Under regulation 2.05(4) of the Migration Regulations 1994, the visa holder must show that, since the visa was granted, compelling and compassionate circumstances have developed over which they had no control, and that those circumstances have resulted in a major change to their situation. Examples that may be considered include serious illness or injury, the death of a close family member, or a natural disaster or civil unrest in the home country.

Circumstances that were within the person's control, or that were foreseeable when the visa was granted, are generally not sufficient. Starting a relationship or deciding to remain in Australia will not usually meet the threshold on their own. A waiver does not grant a new visa or extend the current one. It only allows a further application to be made while in Australia. A refused waiver request cannot be reviewed on its merits by the Administrative Review Tribunal (ART), and judicial review is limited to jurisdictional error.

The Regulations also contain a separate, narrower waiver circumstance for visa holders with a genuine intention to apply for certain skilled and employer sponsored visas. If a waiver is granted on that basis, strict follow-on rules limit which visa applications remain valid, so the pathway needs to be settled with proper advice before any request is made.

Moving From a Visitor Visa to a Partner Visa

Where a visitor visa is not subject to Condition 8503 and the relationship meets the legal requirements, a Partner visa (Subclass 820/801) application may be lodged in Australia. The Subclass 820 is the temporary stage. In most cases, eligibility for assessment of the permanent Subclass 801 stage arises two years after the combined Partner visa application was lodged. If the visitor's visa has already expired when the application is made, additional Schedule 3 criteria apply, and the applicant may need to show compelling reasons for those criteria to be waived.

Where Condition 8503 applies, the relationship itself is generally not treated as a circumstance beyond the applicant's control for waiver purposes. In that situation, offshore options such as the Partner visa (Subclass 309/100) or the Prospective Marriage visa (Subclass 300), both of which must be applied for outside Australia, are often assessed instead. Section 48 of the Migration Act 1958 also limits further onshore applications by a person in Australia who does not hold a substantive visa and has had a visa refused or cancelled since last entering Australia, although Partner visas are among the exceptions prescribed by regulation 2.12.

Moving From a Visitor Visa to a Skilled or Employer Sponsored Visa

The points-tested skilled visas include the Skilled Independent visa (Subclass 189), the Skilled Nominated visa (Subclass 190) and the Skilled Work Regional (Provisional) visa (Subclass 491), which offers a later pathway to the Permanent Residence (Skilled Regional) visa (Subclass 191). Each requires an Expression of Interest through SkillSelect, an invitation to apply, a suitable skills assessment in an eligible occupation, at least Competent English, and a points score that meets the invitation. Applicants must also be under 45 when invited. The Subclass 190 and Subclass 491 additionally require state or territory nomination, or eligible family sponsorship for the Subclass 491.

These visas can generally be lodged in or outside Australia, so the question for a visitor visa holder is usually whether Condition 8503 applies, rather than whether the visa itself allows an onshore application. Employer sponsored options, including the Skills in Demand visa (Subclass 482) and the Employer Nomination Scheme visa (Subclass 186), require a sponsoring employer and an approved nomination. Holding a visitor visa while an employer considers sponsorship does not allow you to start working.

Visitor visa holders who wish to study in Australia before pursuing a skilled pathway should also be aware that, since 1 July 2024, a student visa (Subclass 500) application cannot be lodged from within Australia while holding a visitor visa. Anyone in that position must apply for a Student visa from outside Australia.

Applying for Permanent Residency From Outside Australia

For many people, applying for permanent residency from outside Australia can be the more straightforward option. Skilled visas, the Partner visa (Subclass 309/100), the Direct Entry stream of the Subclass 186, and several family visas can be lodged offshore. An offshore application avoids the validity problems created by Condition 8503 and section 48, although some visas also require the applicant to be outside Australia when the visa is granted. Departing Australia before your visitor visa expires, and in line with its conditions, also helps protect your immigration history for future applications.

常見問題

Can I apply for permanent residency on a visitor visa?

Holding a visitor visa does not, by itself, prevent a permanent visa application, but it gives no entitlement to one. Whether you can lodge onshore depends on whether Condition 8503 applies, whether section 48 affects you, and whether you meet every criterion of the permanent visa you are considering.

Can I apply for another visitor visa while I plan my next step?

A further visitor visa application made in Australia is also blocked by Condition 8503 unless a waiver is granted. Where no such condition applies, the Department of Home Affairs will still assess whether you genuinely intend a temporary stay, and repeated onshore applications can attract closer scrutiny.

Does leaving Australia remove Condition 8503?

Condition 8503 operates while the holder remains in Australia after entering on that visa. Once you depart, it does not prevent an application made from outside Australia, although any new visa may carry its own conditions.

How much does it cost to apply for a visitor visa in 2026?

From 1 July 2026, the application charge for the Subclass 600 Tourist stream is $250 for applications lodged from outside Australia, and $630 for applications lodged from within Australia. Other streams, including Business Visitor and Sponsored Family, attract a charge of $250. The Frequent Traveller stream, available to eligible Chinese nationals, is $1,845. These charges apply to applications lodged on or after 1 July 2026.

Will all visitors visas soon carry a No Further Stay condition?

The government has announced that Condition 8503 will be applied to all Visitor visa (Subclass 600) grants, but this measure has not yet commenced. The Department of Home Affairs has not yet published the legislative instrument giving it effect. Visitor visa holders who are considering an onshore application for any visa should seek advice now, as the position may change quickly once the instrument is published.
