That is, because you can get permanent residency via the partner visa route without a skill or qualification, many people pretend to be in fake relationships, sometimes referred to in the movies as ‘sham marriages’’. Fraudsters coordinating fake relationships for visa purposes often go to great lengths to obtain evidence, including documents, to support their application. This means that it is difficult for the Australian Government to distinguish between your genuine relationship and someone trying to get permanent residency in Australia by way of a fake relationship. Unfortunately, this results in thousands of partner visas being refused. The Department of Home Affairs' own reporting shows the primary refusal rate for partner visa applications has generally sat in the single digits in recent years, though it can vary by year and visa stream. If your partner visa application is initially refused, you can appeal to Australia’s Administrative Review Tribunal (ART) and a meaningful proportion of refusals are overturned at the ART each year after applicants provide stronger evidence that their relationship is genuine. It is important to understand however that if your partner visa is refused, you may have to wait up to two years for Australia’s administrative review tribunal to schedule a tribunal hearing, hear your evidence and determine your appeal. The timing of your partner visa application depends on your circumstances. Generally, you can lodge a partner visa application to the Department of Home Affairs at any time if you are in a de facto relationship or married to an Australian citizen, permanent resident or eligible New Zealand citizen. Note that this timing question is separate from the choice between the onshore Subclass 820 and offshore Subclass 309 pathways; that choice depends on whether you are inside or outside Australia at the time of lodgement, not on how long you have been together

If you are legally married to someone other than your Australian partner, or you are not yet divorced from a previous spouse, this can affect your eligibility. If your partner visa application is based on marriage, you and your partner must both be free to marry, meaning any previous marriage must have been validly ended by divorce, death or annulment recognised under Australian law. If your application is instead based on a de facto relationship, you do not need to be divorced from a previous spouse to apply, provided you meet the de facto relationship requirements and are not still living with a previous spouse as a couple. It’s an exciting prospect, but here's the thing to remember: when you apply for the temporary partner visa, your student visa doesn't stop immediately. It continues until its expiry date. That means you should keep studying and comply with the conditions of your student visa, even while your partner visa application is being processed. Once your student visa expires, a Bridging Visa A will ordinarily become active. This bridging visa allows you to lawfully stay in Australia while you're waiting for the outcome of your partner visa application. A Bridging Visa A granted on lodgement of an onshore partner visa generally carries full work rights, though the specific conditions attached to your bridging visa depend on the conditions of the substantive visa you held immediately beforehand , always confirm your bridging visa conditions on VEVO.

In most cases, you cannot apply for a partner visa while on a bridging visa. In rare cases, a partner visa application can be made on compassionate or compelling grounds that would need to satisfy particular Schedule 3 criteria. This criteria is difficult to satisfy. Schedule 3 generally requires you to show compelling reasons for not applying for the partner visa earlier, and compelling circumstances affecting the interests of an Australian citizen, permanent resident or eligible New Zealand citizen, such as your partner or any children of the relationship.
