What is an Administrative Review Tribunal (ART) Appeal?

An Administrative Review Tribunal (ART) appeal is a legal process that lets eligible applicants seek an independent merits review of certain visa decisions made by the Department of Home Affairs. The ART was established under the Administrative Review Tribunal Act 2024 and replaced the former Administrative Appeals Tribunal (AAT) from 14 October 2024. The Tribunal reassesses the facts and the law to decide whether the original decision should be upheld or changed.

ART Appeal Process for Visa Decisions

1

Reviewing your visa refusal or cancellation decision

The process starts with a detailed review of the decision to identify the reasons for refusal or cancellation and assess what review rights are available.

2

Lodging an appeal with the ART

An application for review must be lodged within the prescribed time limit and in line with the Tribunal's requirements, including the applicable filing fee.

3

Preparing legal submissions and supporting evidence

Comprehensive submissions and supporting documents are prepared to address the issues raised in the original decision.

4

Attending the tribunal hearing

Where the matter proceeds to an oral hearing, applicants may need to attend, and the Tribunal will consider the evidence and may ask questions. Before the hearing, the Tribunal may issue case management directions setting out timeframes and procedural steps.

5

Tribunal decision and next steps

The Tribunal Member will issue a decision, which may affirm the original decision, set it aside, or remit the case, depending on the circumstances.

ART Appeal Deadlines and Time Limits

Time limits to lodge an ART appeal

Strict time limits apply, and these vary depending on the type of decision and the applicant's circumstances. In many cases, applicants have between 7 and 28 days from the date they're notified of the decision to lodge an appeal with the ART. A shorter, 9-day time limit applies specifically to Section 501 or 501CA character decisions where the person is in the migration zone, and the Tribunal has no power to extend this deadline under any circumstances.

What happens if you miss the deadline

Failing to lodge an appeal within the required timeframe can mean losing your review rights, generally with no ability to extend the deadline for migration matters, though limited exceptions can apply in some circumstances.

Factors affecting appeal timelines

How long an appeal takes can depend on case complexity, the availability of evidence, and the Tribunal's workload.

Documents Required for an ART Appeal

Visa refusal or cancellation notice

The original decision notice is essential to understanding the reasons for refusal or cancellation.

Supporting evidence addressing refusal reasons

Applicants should provide evidence that directly addresses the issues identified in the decision.

Personal statements and statutory declarations

Statements can help clarify circumstances and give the Tribunal additional context.

Additional documents strengthening your case

Further documentation, such as character references or expert reports, may help support your claims and demonstrate eligibility.

What Happens During an ART Hearing?

How tribunal hearings are conducted

Hearings are typically conducted in a formal setting where the Tribunal reviews the evidence and considers the submissions made. Not every matter proceeds to an oral hearing — some are decided on the papers, depending on the type of decision and the Tribunal's own processes.

Questions asked during the hearing

The Tribunal may ask questions to clarify aspects of the application, the evidence, or your personal circumstances.

Role of migration lawyers during the hearing

Migration lawyers help by preparing clients, presenting legal arguments, and making sure procedural fairness is followed throughout the hearing.

Possible Outcomes of an ART Appeal

Tribunal sets aside the Department's decision

The Tribunal may replace the original decision with a new outcome, which may be more favourable to the applicant.

Tribunal affirms the refusal decision

The Tribunal may agree with the Department's decision and uphold the refusal or cancellation.

Tribunal sends the case back for reconsideration

In some cases, the matter may be remitted to the Department for reconsideration in line with the Tribunal's findings.

What If Your ART Appeal Is Unsuccessful?

Judicial review in the Federal Circuit and Family Court

Applicants may be able to seek judicial review where there's an arguable jurisdictional error in the Tribunal's decision.

Alternative visa pathways

Depending on individual circumstances, an alternative visa option may be available.

Ministerial intervention in exceptional circumstances

In very limited circumstances, provisions such as Section 351 allow the Minister a personal, non-compellable power to substitute a more favourable decision where it's considered in the public interest. This power is discretionary and can't be requested as a matter of right.

Seeking further migration legal advice

Professional legal advice can help identify the right next steps after an unsuccessful appeal.

Costs Involved in an ART Appeal

Administrative Review Tribunal application fees

Effective from 1 July 2026, the ART filing fee is AUD $3,727 for most migration visa reviews, with a 50% reduction available in cases of financial hardship. Protection visa reviews don't require a fee at application stage, but a fee of AUD $2,293 becomes payable if the review is unsuccessful. Character-related refusals or cancellations are charged a lower standard fee of AUD $1,195, with a reduced fee of AUD $100 available in special circumstances.

Legal representation and preparation costs

Legal fees vary depending on the complexity of the case and the level of representation required.

Additional document preparation expenses

Costs may arise for obtaining supporting evidence, translations, and other documentation.

ART Sydney Registry

The ART's Brisbane Registry

If your matter is being heard through the ART's Brisbane registry, hearings and case management are generally handled through that registry rather than interstate. The Tribunal's Brisbane registry address is:

Level 6, No1 Anzac, 295 Ann Street, Brisbane QLD 4000 GPO Box 9955, Brisbane QLD 4001

This is the Tribunal's own registry, not an Australian Migration Lawyers office. Our Brisbane migration lawyers can represent you in proceedings before this registry, including hearings conducted in person, by phone, or by video link.

FAQs About ART Appeals Brisbane

It's an independent body that reviews certain decisions made by the Department of Home Affairs, established under the Administrative Review Tribunal Act 2024 to replace the former AAT.

Time limits vary depending on the type of decision and your circumstances, and strict deadlines apply, with some categories, such as certain character-related decisions, subject to a much shorter window than the standard timeframe.

Timeframes vary depending on case complexity and the Tribunal's capacity, but appellants can generally expect the matter to take somewhere between 1 and 3 years to be finalised.

In some cases, you may be granted a bridging visa that lets you remain in Australia while the appeal is ongoing.

You may be able to seek judicial review where a jurisdictional error occurred, explore an alternative visa pathway, or, in very limited circumstances, seek ministerial intervention.

While not mandatory, legal representation can help with preparing submissions, addressing legal issues, and presenting your case effectively.

This page provides general legal information, not legal advice, and doesn't take into account your individual circumstances. If your situation is time-sensitive, we'd encourage you to book a consultation with our team as soon as possible to get advice specific to you.
