The offshore partner visa moves through two stages - the subclass 309 (provisional) stage, followed by the subclass 100 (permanent) stage.

Stage 1: Partner Visa 309 (Provisional)

You must supply significant evidence to establish the genuine and ongoing nature of your relationship, along with personal records such as identity and character documents. Once granted, the subclass 309 visa authorises your entry to Australia, where you can stay without restriction for around two years before becoming eligible to apply for the permanent partner visa (subclass 100).

Stage 2: Partner Visa 100 (Permanent)

After two years on the 309 visa, you become eligible to apply for the subclass 100 visa. This stage requires you to provide updated evidence that your relationship is still genuine and ongoing.

Double Grant of Subclass 309 and 100 Visas

A double grant means the Department of Home Affairs grants your subclass 309 and subclass 100 visas at the same time, rather than in two separate stages. This can happen when your relationship has already lasted long enough at the time of application to satisfy the requirements for permanent residency directly. Applicants in longstanding relationships spanning several years may be eligible for a double grant of the partner visa 309/100.
