The single leading cause of student visa cancellation is a breach of Condition 8202, which requires you to remain enrolled full-time in a CRICOS-registered course, maintain satisfactory attendance and academic progress, and not move to a lower Australian Qualifications Framework level course without first obtaining a new visa. Your education provider is legally required to monitor this and report any breach to the Department through PRISMS, the Provider Registration and International Student Management System, before the Department takes any action.

The response window given in a NOICC varies by case, commonly somewhere between 5 and 28 days, and the notice will state your specific deadline, the ground being relied on, such as a breach of condition 8202, and the facts the Department is relying on, often drawn from PRISMS reports. Receiving a NOICC does not mean your visa has already been cancelled, it is your opportunity to respond before any decision is made, but the deadline is strict and should be treated as urgent.

Cancellation decisions of this kind are generally made under section 116 of the Migration Act 1958, which sets out the general grounds on which a visa can be cancelled, including a breach of a visa condition, providing incorrect information, or the Department becoming satisfied the holder is no longer a genuine student. This is a different legal mechanism to the mandatory cancellation and character test provisions covered in our separate guide on section 501.

Eligibility for a Bridging Visa E depends heavily on individual circumstances, and it does not come with automatic work rights, so this is an area where individualised legal advice is essential.

If your course itself is cancelled by your provider:

A cancellation of your course by your education provider, rather than a cancellation of your visa itself, is a different and separate situation, though it can lead to a visa breach if not addressed. You generally need to find and enrol in a replacement course within a reasonable period, commonly cited as around 28 days, to remain compliant with condition 8202's requirement that you remain enrolled. If your provider's closure or course cancellation was itself the issue, the Tuition Protection Service can help you find a suitable replacement course or, in some circumstances, a refund, and engaging with this service promptly is an important first step.

If my student visa is cancelled, can I apply again in Australia?

This depends on the grounds for cancellation. If the cancellation was on non-character grounds and you remain eligible for a different visa, you may be able to apply while still in Australia. If it was on character grounds, you generally cannot apply for another visa while remaining in Australia. If you have already left Australia, whether you can apply again depends on whether any exclusion period or Special Return Criteria applies to your case.

What is condition 8202?

Condition 8202 is a mandatory condition on all primary Subclass 500 student visas requiring you to remain enrolled full-time in a CRICOS-registered course, maintain satisfactory attendance and academic progress, and not move to a lower AQF level course without a new visa.
