When the Department of Home Affairs refuses a visa, you'll receive a written decision setting out the reasons for refusal and whether you have a right to seek review. In many cases, this means you may be eligible to seek merits review of a reviewable migration decision through the Administrative Review Tribunal (ART).
Strict deadlines apply depending on your circumstances, often ranging from just a few days to several weeks. Acting quickly matters, since missing the window can mean losing your review rights altogether.
Failure to meet visa eligibility requirements
An application can be refused where the specific criteria for the visa subclass applied for aren't met. In many cases, this is a decision made under Section 65 of the Migration Act, which sets out the Minister's power to grant or refuse a visa based on whether the criteria are satisfied.
Insufficient supporting documents
Missing or incomplete evidence is one of the most common reasons for a refusal.
Incorrect or misleading information
Errors, inconsistencies, or unintentional misstatements in an application can significantly affect the outcome.
English language or financial requirements
Not meeting the minimum language or financial thresholds required can lead to refusal.
Character or health concerns
Applicants need to satisfy Australia's character and health requirements, and not doing so can result in refusal.
We start with a detailed review of the refusal notice and the Department's reasoning, identifying the factual findings, the legal criteria applied, and any potential errors in how the application was assessed.
Not every refusal carries a right of appeal. We assess whether you hold valid merits review rights, which division of the ART has jurisdiction, and whether strict filing deadlines apply, and we consider whether an appeal, a fresh application, or an alternative visa pathway is the most appropriate route for your circumstances.
Where you're eligible, we prepare and lodge your application with the ART within the required timeframe, ensuring all procedural requirements are met at the time of filing, since missing the deadline can permanently remove your right to review.
We build a structured legal strategy backed by detailed written submissions, statutory declarations, and documentary evidence, which may include directly addressing the refusal concerns, correcting inconsistencies, and providing new or strengthened evidence.
Your matter is then listed for a hearing, where an ART member reviews the evidence and may ask questions. We prepare you for the hearing, present your legal arguments, and respond to any issues raised. A written decision then follows, which may affirm, vary, or set aside the original refusal.
The ART is an independent body that reviews certain visa refusal decisions made by the Department. It doesn't act for the Department, and is required to reach its own fresh decision based on the evidence and the law, considering the grounds for merits review put forward.
Only applicants with valid merits review rights under the Migration Act can apply, and eligibility depends on factors including the visa subclass, your location at the time of refusal, and any sponsorship arrangements involved. We assess these factors to confirm whether an appeal is legally available, since some decisions are non-reviewable and sit outside the ART's jurisdiction, leaving ministerial intervention as the only, entirely discretionary, avenue.
Hearings before the Migration and Refugee Division of the ART are more informal than court proceedings, though still legally structured. You may need to answer questions about your application, clarify evidence, and respond to concerns raised by the Tribunal member, and proper preparation matters given how much the hearing can influence the outcome.

Strict deadlines apply depending on your visa type and where you were at the time of refusal, and in many cases you may only have a short window, often somewhere between 7 and 28 days, to lodge an appeal with the ART. In limited circumstances, an extension of the standard time limit may be requested where compelling circumstances are shown to have prevented an earlier application, though this is assessed on a case-by-case basis and isn't automatic.
Tribunal processing times can vary considerably depending on complexity and workload, commonly ranging from several months to over a year.
Administrative Review Tribunal application fees
As at 1 July 2026, the standard ART application fee for a reviewable migration decision is $3,727, with a hardship reduction available in appropriate circumstances. For a reviewable protection decision, the fee is $2,293, which is generally only payable if the review is unsuccessful, and a concessional fee of $100 may apply in eligible cases.
