No Visa, No Fee

Choosing a migration lawyer is one of the most important decisions you'll make in your visa journey, and it's a decision you want to feel confident about from the outset. Australian Migration Lawyers offers a No Visa, No Fee option on selected visa applications. If you engage us on this basis and your visa is refused, we refund our professional legal fees. It's a way of aligning our interest with yours: we only extend this option where we're confident, based on a proper assessment of your circumstances, that your application meets the requirements of the visa you're applying for.

What "No Visa, No Fee" means

No Visa, No Fee is a professional fee refund policy. If your application is refused, we refund the legal fees you've paid us for that matter. It is not, and cannot be, a promise that your visa will be approved. No migration lawyer or migration agent can lawfully guarantee a visa outcome, and Australian Migration Lawyers does not make that claim. What we can offer is this: if we take on your matter under this option, and it doesn't succeed, you don't pay for our work on it.

This distinction matters because it changes how the option should be understood. It's not a marketing promise that removes all risk from your application. It's a genuine financial undertaking we make once we've assessed your circumstances and are confident enough in your prospects to share that risk with you.

What's included

Fee refund on refusal

If your visa application is refused, the professional fee you've paid us for that matter is refunded in full.

Assessed before you commit

We only offer this option once a migration lawyer has reviewed your circumstances and evidence against the visa requirements.

Fixed fee, confirmed in writing

Your fee is set out in a written costs agreement before any work begins, so you know what you're paying and what's covered.

Direct access to a migration lawyer

You deal directly with a migration lawyer from consultation through to the outcome of your application.

What isn't covered

No Visa, No Fee covers our professional legal fees. It doesn't extend to costs payable regardless of who prepares your application, or to refusals caused by something outside our control:

  • Visa application charges paid to the Department of Home Affairs, set independently of AML and never refundable.
  • Third-party costs, such as skills assessments, English testing, or health examinations, paid to independent providers, not to AML.
  • Certified translation fees, where documents need translation into English.
  • Refusal caused by a client withholding or misrepresenting information, or missing agreed deadlines.

How it works

Consultation and assessment

We assess your circumstances, history, and evidence against the requirements for your visa Subclass, and whether your matter qualifies for No Visa, No Fee.

Offer and engagement

If we're confident in your prospects, we'll offer you the option in writing, with a costs agreement setting out the fee, what's covered, and what's excluded.

Preparation and lodgement

We prepare your application to the same standard as every matter we handle, and lodge it with the Department of Home Affairs, the courts, or the Administrative Review Tribunal (ART), as relevant.

Kinalabasan

If your visa is granted, the matter concludes as normal. If it's refused, we refund our professional fee under the terms of your costs agreement.

Which visas qualify

No Visa, No Fee is offered on selected visa types, generally where eligibility can be assessed clearly and confidently at the outset. It's applied on a case-by-case basis rather than automatically across every visa Subclass we handle, and whether it's available to you depends on the strength of your individual circumstances at consultation, not on the visa category alone.

If your matter doesn't qualify for this option, that doesn't mean your application is weak. It may simply mean the visa category involves factors that are harder to assess with confidence in advance, such as more subjective eligibility criteria or a higher degree of discretion in the decision-making process. In those cases, we'll still tell you honestly where things stand and set out our standard fee arrangement instead.

What happens if my application is refused and I want to appeal or reapply?

We'll discuss your options with you once we know the outcome and the reasons for refusal. Depending on your circumstances, this might include a fresh application or a review through the Administrative Review Tribunal (ART). These next steps are separate from the No Visa, No Fee refund on your original matter and would be discussed and agreed separately.

Does this apply to every visa type AML handles?

How do I find out if my matter qualifies?

What exactly do I get back if my visa is refused?

The professional service fee you paid us for that matter. Government charges paid to the Department of Home Affairs, and any third-party costs such as skills assessments or health examinations, aren't included, because these are payable to other bodies regardless of who prepares your application.

Does No Visa, No Fee mean my visa is guaranteed to be approved?

No. It means our professional fee is refunded if your visa application is refused. No migration lawyer or migration agent in Australia can lawfully guarantee a visa outcome, and we don't make that claim. What we can offer is confidence in our own assessment of your matter, backed by a genuine financial undertaking.
