Applicants need to satisfy the genuine relationship test — showing the relationship is authentic and ongoing, in line with the standard set under Australian migration law. The Department of Home Affairs expects a solid body of evidence before it will be satisfied on this point.

Marriage or de facto relationship requirements

Depending on the pathway, the relationship needs to meet the legal definition of either a marriage or a de facto partnership. For de facto couples, this generally means having lived together on a genuine domestic basis for the 12 months immediately before lodgement, with limited exceptions, including where the relationship is formally registered (South Australia runs its own Relationships Register) or where compelling and compassionate circumstances apply.

Every applicant needs to satisfy Australia's health and character requirements, which includes medical assessments and police checks.

Sponsor eligibility requirements
