Genuine and continuing relationship requirement
Marriage or de facto relationship requirements
Health and character requirements
Sponsor eligibility requirements
Financial aspects of the relationship
Evidence of joint finances, such as shared accounts, combined liabilities, or other financial interdependence, helps demonstrate the relationship.
Household arrangements
Proof of a shared household, including joint leases, utility accounts, or shared domestic responsibilities, may be needed to show a genuine living arrangement.
Social recognition of the relationship
Evidence can include statements from family and friends, social documentation, and public acknowledgment of the relationship.
Commitment to each other
Applicants typically support their commitment with communication records and a written relationship history statement outlining how the relationship developed. Statutory declarations from the couple and their witnesses can also help, along with an apostilled marriage certificate where the marriage took place overseas and formal certification is required.
The process begins with a detailed assessment of your relationship and visa eligibility to determine the most appropriate pathway.
Comprehensive evidence is prepared to demonstrate the genuine and continuing nature of the relationship in accordance with migration requirements.
The application is lodged through the Department's ImmiAccount system, supported by relevant documentation and submissions, together with the government application charge. Onshore applicants who hold a substantive visa at the time of lodgement are generally granted a Bridging Visa A, which lets them stay lawfully in Australia while the application is assessed.
Ongoing support is provided throughout the assessment process, including responding to Departmental requests and managing case updates.
Partner visa applications call for careful preparation and a solid evidentiary base to establish that the relationship is genuine. A migration lawyer can help make sure your application is put together correctly and backed by the right documentation.
Legal support can also help catch potential problems early, cut down the risk of delays, and keep the application in step with changing migration requirements.
Australian Migration Lawyers offers tailored legal support to couples throughout the partner visa process. Reach out to our Gold Coast team to discuss your circumstances.
Government partner visa application fees
As of 1 July 2026, the Department of Home Affairs charges $11,710 for the primary applicant on the combined 820/801 (onshore) or 309/100 (offshore) application, $5,860 for each additional applicant aged 18 or over, and $2,935 for each additional applicant under 18. This single charge covers both stages of the pathway, with no separate Department fee payable when the permanent stage is later decided.
Legal and professional service fees
Professional fees depend on the complexity of the application and the level of legal assistance required.
Additional documentation and translation costs
Additional costs may apply for document preparation, certified translations, and supporting evidence.
Factors affecting processing times
Processing times can vary depending on how complete the application is, the complexity of the relationship, and the Department's current workload.
Typical partner visa timelines
Partner visa applications are generally assessed over an extended period, particularly where further information or relationship verification is requested.
Insufficient relationship evidence
Applications may be refused where the evidence doesn't adequately establish a genuine and continuing relationship.
Inconsistent information in the application
Discrepancies between documents or statements can work against the application.
Sponsor eligibility issues
A sponsor who doesn't meet the eligibility requirements can result in refusal.
Character or health concerns
Applicants must meet health and character standards to remain eligible for visa approval.
Our Gold Coast partner visa lawyers provide clear, thorough, and strategic legal support for relationship-based visa applications. We focus on making sure your application is properly put together, backed by strong evidence, and consistent with current migration law.
