Visa Appeal & Administrative Review Tribunal Costs and Fees

For visa applicants hoping to build a life in Australia, receiving a visa refusal or cancellation notice from the Department of Home Affairs can be heartbreaking. Our team at Australian Migration Lawyers have years of experience representing clients at the Administrative Review Tribunal (ART) for contestable visa refusals and cancellations, and are familiar with the process. We recognise for our clients that when challenging a decision, navigating the financial requirements of an administrative review is an essential first step.

Whether you are seeking to lodge an appeal, or seek a merits review through the ART, it is crucial that applicants understand the costs involved.

Lodging an appeal requires careful budgeting, as applicants must account for both government fees and mandatory administrative or legal costs. In this guide, we break down the costs associated with appealing a visa decision, including mandatory administrative review application fees, potential fee reductions, and secondary expenses involved in preparing a comprehensive review application.

What Are the Administrative Review Tribunal Fees?

When appealing a decision made under the Migration Act 1958 (Cth), applicants must pay a tribunal application fee directly to the ART. The fees depend on the type of decision under review and the fee is separate from the original visa application charge.

The table below outlines the standard government tribunal fees applicable for merits review applications.

Applicant / review type ART application fee Reduced fee Refund / when payable
Part 5 migration review $3,727 $1,863.50 if hardship reduction approved 50% refund if the decision is set aside, varied, or remitted
Character-related refusal or cancellation $1,195 standard fee $100 if eligible under standard-fee rules Refund of fee paid minus $100 if decided in applicant's favour
Specified protection review No fee on lodgement; $2,293 may later be payable Not applicable $2,293 fee payable only if the review is unsuccessful

Note that the above ART fees and payment rules apply as of 30 September 2026. Please check the ART fee schedule and your decision notice for the most recent figures.

Are There Additional Out-of-Pocket Costs?

Other costs depend on the issues in your case and the evidence needed:

Updated Health Examinations: You may need to undergo new medical examinations or specialist assessments to satisfy health criteria under Public Interest Criterion (PIC) 4005 or 4007.

National Police Certificates & Foreign Background Checks: Updated police clearances from Australia or overseas jurisdictions may be required to address character concerns.

Professional Translations: Any evidentiary document not originally issued in English must be translated by a certified National Accreditation Authority for Translators and Interpreters (NAATI) translator.

Legal Representation Cost for Appeal: Engaging an experienced migration lawyer to review the primary refusal, prepare written legal submissions, compile supporting evidence, and represent you during oral hearings.

Budget separately for the tribunal charge, any evidence you need to obtain, and professional fees if you choose representation.

Who Pays What?

Understanding the distinction between statutory obligations and professional service fees helps manage total expenditure:

Fixed Government Fees

The ART sets the applicable review fee. The amount and payment deadline depend on the review type; check the current fee schedule when you apply. Fees may change over time.

Variable Legal Representation and Document Fees

Legal fees and document costs depend on the work required.

Representation may include:

  • Analysing the Department’s decision and identifying legal or factual issues.
  • Formulating tailored legal arguments under the Migration Act 1958 (Cth) and Migration Regulations 1994 (Cth).
  • Drafting witness statements and organising supporting expert evidence.
  • Preparing you for the tribunal hearing and advocating on your behalf within the ART process.

Common Budgeting Pitfalls in Visa Appeals

When estimating the total cost of an ART review, watch for these common budgeting errors:

Multiple review applications

Do not assume every family member pays a separate fee, or that one fee always covers the family. The ART can order one fee for multiple reviews dealt with together in certain circumstances; ask when lodging.

Misunderstanding hardship timing

For a Part 5 review, pay at least half the fee by the review deadline and provide the hardship request and evidence before the review is finalised.

Budgeting Only for Tribunal Fees

Focusing solely on the application fee without budgeting for expert reports, country-of-origin evidence, or legal representation.

Assuming a full refund

A favourable Part 5 outcome generally produces a refund of 50% of the fee actually paid, not the whole fee. Other review types have different rules.

Frequently Asked Questions

The current charge for a Part 5 migration review is $3,727. In case the ART reserves, varies or sends back the matter to the Department, 50% of the payment is refunded to the applicant. Generally speaking, character related visa refusal or cancellations require the ART standard fee of $1,195. However, fee and outcome regulations differ for protection assessments.

For a Part 5 migration review, the ART may reduce the $3,727 fee by 50% if payment would cause or has caused financial hardship. Pay $3,727 or $1,863.50 by the review deadline, then lodge the reduction request with supporting documents before the review is finalised. If the reduction is refused, the balance remains payable.

In most cases, there will be no refund of the ART tribunal application fee, unless the ART has accepted your claim. A refund of either your full application fee or half of your application fee will typically occur when the ART makes a favourable ruling on your behalf, or if an administrative mistake was made.

Migration lawyer fees are a separate cost from the ART from costs associated with the ART. These legal fees will vary depending on the complexity of the matter and the scope of work required.

At Australian Migration Lawyers, we provide fixed-cost arrangements after meeting initially with our client so they know what their legal costs will be prior to commencing.
