Every partner visa application is assessed against the genuine relationship test, which requires the applicant to show the relationship is authentic and ongoing, and not entered into for migration purposes. The Department of Home Affairs looks for evidence across several categories rather than relying on any single document.

Marriage or de facto relationship requirements

The relationship must satisfy the legal definition of marriage or de facto partnership that applies to the chosen pathway. For a de facto relationship, applicants generally need to meet the requirement of having lived together for at least 12 months immediately before applying, sometimes referred to as the de facto 12 months requirement, though this can be waived where the relationship is registered under state or territory law.

Health and character requirements

All applicants must satisfy Australia's health and character requirements, including medical and police checks.

Sponsor eligibility requirements

Partner visa sponsor eligibility requirements include being an Australian citizen, permanent resident or eligible New Zealand citizen, and meeting the sponsorship obligations that come with the role. A sponsor who does not meet these criteria, or who has a relevant criminal history, may affect the outcome of the application.

A relationship history statement, often supported by a statutory declaration from the applicant and sponsor for the partner visa, sets out how the relationship began and developed over time. Combined with communication records, this kind of de facto relationship evidence helps establish the mutual commitment element of the application.
