The Australian Migration Lawyers difference

Meet With Our Sydney Partner Visa Lawyers

Navigating a partner visa application involves more than paperwork. It requires a clear legal strategy built around the specific circumstances of your relationship. Our Sydney partner visa lawyers work closely with applicants and sponsors to identify what the Department of Home Affairs will expect to see, and to make sure that expectation is met with substance rather than volume.

Whether you are a spouse visa applicant, a de facto couple, or an engaged couple exploring the marriage pathway, we assess your circumstances individually before recommending a course of action. This includes advising on which visa pathway suits your situation, identifying gaps in existing evidence, and managing communication with the Department throughout the assessment period, including responses to any request for further information.

Australian Migration Lawyers has assisted partner visa applicants across New South Wales with legally sound, well-evidenced applications. Get in touch with our Sydney office to discuss your relationship and the options available to you.

Partner Visa Eligibility Requirements

Genuine and continuing relationship requirement

The relationship must be genuine and ongoing, consistent with the standard set out in Australian migration law, and the Department of Home Affairs will expect substantial evidence before accepting that this standard is met.

Marriage or de facto relationship requirements

Depending on which pathway applies, the relationship needs to satisfy the legal definition of either a marriage or a de facto partnership.

Health and character requirements

Every applicant needs to clear Australia's health and character checks, which include both a medical assessment and police checks.

Sponsor eligibility requirements

To be eligible, a sponsor must be an Australian citizen, permanent resident, or eligible New Zealand citizen and must meet their sponsorship obligations; a sponsor who is ineligible or has a criminal record can put the application at risk of refusal.

Evidence Required for a Partner Visa Application

Financial aspects of the relationship

This might include joint bank accounts, shared bills, or other signs that the couple manages money together.

Household arrangements

Couples may need to show they live together and share day-to-day domestic responsibilities.

Social recognition of the relationship

This can be supported through statements from friends and family, along with other documentation showing the relationship is publicly acknowledged.

Commitment to each other

Couples need to show ongoing mutual commitment, which is often backed up by a history of communication and shared relationship milestones.

Partner Visa Application Process

1

Consultation and engagement

We start with a thorough review of your relationship and eligibility to work out which visa pathway is the right fit.

2

Preparation of relationship evidence

We put together comprehensive evidence to show the relationship is genuine and ongoing, consistent with migration law requirements.

3

Lodgement of the partner visa application

We formally lodge the application with the Department of Home Affairs, backed by supporting documents and submissions.

4

Communication with the Department and ongoing support

We provide continued support throughout the assessment, including handling Departmental requests and keeping the case moving.

Benefits of Using a Sydney Partner Visa Lawyer

A partner visa application succeeds or fails largely on the strength of its evidence. Getting the documentation right the first time matters, particularly given the current processing timeframes and the Department's stated preference for decision-ready applications at lodgement.

Working with a migration lawyer means having someone review your evidence against what the Department is actually assessing, rather than a generic checklist. This can help surface gaps before lodgement rather than after a request for further information arrives.

Our Sydney team supports couples through every stage of the partner visa pathway, from the initial assessment through to lodgement and beyond. Reach out to discuss your circumstances with our Sydney office.

Costs Involved When Applying for a Partner Visa in Sydney

Government partner visa application fees

The combined Subclass 820/801 (onshore) or Subclass 309/100 (offshore) pathway carries a government charge of $11,710 for the primary applicant, effective 1 July 2026, with extra charges applying for any additional applicants on the same application. This charge is set by the Department of Home Affairs and reviewed each year.

Legal and professional service fees

What you pay in legal fees will depend on how complex the matter is and how much support the application needs.

Additional documentation and translation costs

Extra costs can come up around preparing documents, getting certified translations done, or gathering further evidence.

Partner Visa Processing Times in Sydney

Factors affecting processing times

How long an application takes depends on things like how complete it is at lodgement, how complex the relationship is, and how busy the Department is at the time.

Typical partner visa timelines

Partner visa applications tend to take a considerable amount of time to assess, especially where the Department needs extra information or further verification of the relationship.

Common Reasons Partner Visa Applications Are Refused

Insufficient relationship evidence

A refusal can result if the evidence provided doesn't clearly establish that the relationship is genuine and ongoing.

Inconsistent information in the application

Where documents or statements don't line up with each other, this can work against the application.

Sponsor eligibility issues

If the sponsor doesn't meet the eligibility requirements, the application may be refused as a result.

Character or health concerns

Applicants need to clear the health and character requirements for the visa to be approved.

FAQs About Partner Visa Sydney

Cost depends on the visa subclass and the government charge that applies, plus any extra professional or documentation costs on top.

This varies a lot based on individual circumstances and how much the Department has on at the time.

Many applicants are able to apply while already in Australia, provided they meet the relevant eligibility and visa conditions.

Whether you can work depends on which stage and subclass of partner visa you currently hold.

Depending on the situation, there may be review rights available or other visa pathways to consider, and it's worth getting legal advice to work out the best next step.

This page provides general legal information, not legal advice, and doesn't take into account your individual circumstances. If your situation is time-sensitive, we'd encourage you to book a consultation with our team as soon as possible to get advice specific to you.
