Ciudadanía australiana

What Is Australian Citizenship?

Australian citizenship is the legal status that grants people full rights and responsibilities as members of Australia. It lets you live in Australia permanently without visa conditions, vote in federal and state elections, apply for an Australian passport, and access certain government benefits. Citizenship also represents a formal commitment to Australian laws, values, and community participation. Since 4 April 2002, Australia has allowed dual citizenship, so becoming an Australian citizen doesn't generally require you to give up any other citizenship you already hold, though this depends on whether your other country's own laws permit it.

Pathways to Australian Citizenship in Australia

Australian Citizenship by Conferral

Citizenship by conferral is the most common pathway for permanent residents who have lived in Australia for a qualifying period. The citizenship by conferral requirements include meeting the residence requirement, passing the character test, and meeting other legal requirements before applying.

Australian Citizenship by Descent

This pathway applies to people born overseas to an Australian citizen parent. Eligibility depends on the parent's citizenship status at the time of the applicant's birth, and citizenship by descent documentation generally needs to establish that parent-child relationship and the parent's citizenship status clearly, alongside the applicant's own identity documents.

Australian Citizenship by Adoption

Children adopted by Australian citizens may be eligible for citizenship depending on where the adoption took place and whether it's recognised under Australian law.

Australian Citizenship Assistance in Darwin

Legal advice for permanent residents applying for citizenship

We provide tailored advice to assess whether you meet the legal requirements for Australian citizenship, including permanent residency status, residency compliance, and travel history. This helps confirm you're eligible before submitting your application and reduces the risk of refusal due to technical or eligibility issues.

Preparing and reviewing citizenship applications

We assist with preparing and carefully reviewing citizenship applications to make sure all information is accurate, complete, and consistent with Department of Home Affairs records, including your IMMI account citizenship application details, identity documents, residency calculations, and supporting evidence, all checked before lodgement to minimise delays or complications.

Support with complex citizenship eligibility issues

We help applicants dealing with more complex circumstances such as gaps in residency, extended overseas travel, visa changes, or uncertainty around lawful residence periods. We assess how these issues affect eligibility and provide guidance on how to properly address them in your application.

Assistance with citizenship refusals and appeals

If your citizenship application is refused, we review the decision in detail and advise on your options. Some refusals can be the subject of a citizenship refused appeal to the ART, generally within a strict time limit, while others carry limited or no review rights depending on the section of the Australian Citizenship Act the refusal was made under.

Australian Citizenship Eligibility Requirements

Permanent residency requirements

You must generally hold permanent residency at the time of application and at the time of decision. We help assess your visa history to confirm you meet this requirement without any gaps or complications.

Residency requirements for citizenship

Applicants must generally satisfy the "4-1-90" residence requirement: four years' lawful residence in Australia immediately before applying, including the last 12 months as a permanent resident (or eligible New Zealand citizen), with no more than 12 months' total absence across the four years and no more than 90 days' absence in the final 12 months. We assist in calculating your residency accurately, including overseas travel and absences that may affect eligibility.

Good character requirement

You must pass the character test that all citizenship applicants are assessed against, which considers criminal history, conduct, and any issues that may be relevant to your suitability as an Australian citizen. Even minor offences or past legal matters may need to be disclosed and properly addressed.

English language and citizenship test requirements

Most applicants must demonstrate basic English ability and pass the Australian citizenship test required for conferral. There are citizenship test exemptions for applicants under 18, aged 60 or over, or who have a permanent or significant physical or mental incapacity affecting their ability to sit the test. We help you understand what's required and make sure you're properly prepared before attending the test.

Documents Required for an Australian Citizenship Application

Passport and identification documents

You must provide valid identity documents such as passports, birth certificates, and photo identification to confirm your identity and background.

Evidence of permanent residency

This includes your permanent visa grant notice and official records confirming your permanent residency status in Australia.

Residency and travel history

A complete travel history is required to verify your compliance with residency requirements, including time spent outside Australia.

Character and supporting documents

Depending on your circumstances, you may need police checks, court records, or statutory declarations addressing character or background matters.

Leer menos
