A NOICC is a formal notice from the Department of Home Affairs indicating your visa may be cancelled on a discretionary ground. It sets out the Department's concerns and gives you a chance to respond before a final decision is made.

Strict deadlines apply, often requiring a response within a short window, commonly between 5 and 28 days depending on the case. Missing this deadline can result in the visa being cancelled without further opportunity to respond. Mandatory cancellation under Section 501 for a person with a substantial criminal record works differently — it doesn't involve a NOICC at all, since it happens automatically once the statutory trigger is met, and the only avenue afterward is a revocation request under Section 501CA, which generally needs to be made within 28 days of the cancellation notice.
