What is an Administrative Review Tribunal (ART) Appeal?

An ART appeal is a legal process that lets eligible applicants seek an independent review of certain visa decisions made by the Department of Home Affairs. The Tribunal reassesses the facts and the law to decide whether the original decision should stand or be changed. The ART was established under the Administrative Review Tribunal Act 2024, replacing the former Administrative Appeals Tribunal (AAT) from October 2024, though its jurisdiction over visa decisions carries on largely unchanged.

ART Appeal Process for Visa Decisions

1

Reviewing your visa refusal or cancellation decision

The process starts with a detailed review of the decision to identify the reasons given and assess what review rights are available.

2

Lodging an appeal with the ART

An application for review needs to be lodged within the applicable time limit and in line with the Tribunal's requirements, generally through ART application lodgement via the Tribunal's own online portal.

3

Preparing legal submissions and supporting evidence

Thorough submissions and supporting documents are prepared to address the issues raised in the original decision.

4

Attending the tribunal hearing

Applicants may be required to attend a hearing, where the Tribunal considers the evidence and may ask questions, or in some matters, the review may proceed by way of paper review without a hearing.

5

Tribunal decision and next steps

The Tribunal issues a decision, which may affirm, set aside, or remit the case, depending on the circumstances, sometimes accompanied by case management directions setting out any further steps required.

ART Appeal Deadlines and Time Limits

Time limits to lodge an ART appeal

Strict time limits apply, and these vary depending on the type of decision and your circumstances. In many cases, applicants have as little as 7 to 28 days from the date of notification to lodge an appeal, though standard time limits for most onshore migration and protection decisions are 28 days, narrowing to 21 days in some circumstances, 9 days for a Section 501 character decision made in the migration zone, and just 7 days for applicants in immigration detention. The ART generally cannot extend these deadlines for migration or protection matters.

What happens if you miss the deadline

Missing the required timeframe can mean losing your review rights, with very limited exceptions.

Factors affecting appeal timelines

How long an appeal takes can depend on the complexity of the case, the availability of evidence, and the Tribunal's workload.

Documents Required for an ART Appeal

Visa refusal or cancellation notice

The original decision notice is essential for understanding the reasons behind the refusal or cancellation.

Supporting evidence addressing refusal reasons

Evidence that directly addresses the issues identified in the decision should be provided.

Personal statements and statutory declarations

These can be used to clarify circumstances and give the Tribunal further context.

Additional documents strengthening your case

Further documentation may be needed to support your claims and demonstrate eligibility.

What Happens During an ART Hearing?

How tribunal hearings are conducted

Hearings are generally conducted in a relatively formal setting, where the Tribunal reviews the evidence and considers the submissions made.

Questions asked during the hearing

The Tribunal may ask questions to clarify aspects of the application, the evidence, or your personal circumstances.

Role of migration lawyers during the hearing

A migration lawyer helps by preparing you beforehand, presenting legal arguments, and ensuring procedural fairness is maintained throughout the hearing.

Possible Outcomes of an ART Appeal

Tribunal sets aside the Department's decision

The Tribunal can replace the original decision with a different outcome.

Tribunal affirms the refusal decision

The Tribunal may agree with the Department's original decision and uphold the refusal or cancellation.

Tribunal sends the case back for reconsideration

In some cases, the matter is remitted to the Department for reconsideration in line with the Tribunal's findings.

What If Your ART Appeal Is Unsuccessful?

Judicial review in the Federal Circuit and Federal Court

You may have the option to seek judicial review where there's an arguable legal error in the Tribunal's decision.

Percorsi alternativi per l'ottenimento del visto

Depending on your circumstances, alternative visa options may still be available.

Ministerial intervention in exceptional circumstances

In very limited circumstances, provisions such as Section 351 allow the Minister a personal, non-compellable power to substitute a more favourable decision where it's considered in the public interest. This power is discretionary and can't be requested as a matter of right.

Seeking further migration legal advice

Professional legal advice can help identify the right next steps following an unsuccessful appeal.

Costs Involved in an ART Appeal

For a reviewable protection decision, there is no fee to apply, with a fee of $2,293 generally only payable if the review is unsuccessful, and a concessional fee of $100 may apply in eligible circumstances. For character-related refusals or cancellations, such as those made under Section 501, the fee is $1,195, with a concessional fee of $100 available in eligible circumstances.
