Applicants need to satisfy what's sometimes called the genuine relationship test, showing the relationship is ongoing and meets the standards set under Australian migration law. The Department of Home Affairs expects substantial evidence before accepting that a relationship is genuine and continuing.

Marriage or de facto relationship requirements

Depending on the pathway, the relationship must meet the legal definition of either a marriage or a de facto partnership. De facto couples generally need to show at least twelve months living together to meet the de facto relationship requirement, unless an exception applies, such as a registered relationship or a shared child.

Health and character requirements

All applicants must meet Australia's health and character standards, including medical examinations and police checks.

Sponsor eligibility requirements

Sponsor eligibility rules require sponsors to be an Australian citizen, permanent resident or eligible New Zealand citizen, and to meet ongoing sponsorship obligations. An ineligible sponsor, or one with a relevant criminal history, can lead to the application being refused.
