To be assessed for the Subclass 801 visa, you generally need to reach your "eligible date," which is two years after the date you originally applied for the Subclass 820 visa. In some circumstances, such as where you and your partner had already been in a long-term de facto relationship (generally three years, or two years if there is a dependent child of the relationship) at the time of your original 820 application, you may become eligible for the 801 stage sooner. Once you reach your eligible date, the Department will generally begin the second-stage assessment against your existing application automatically, without requiring you to lodge anything further, provided your relationship is ongoing and your circumstances haven't changed in a way that affects eligibility.
