Sponsorship by an eligible Australian citizen or permanent resident
Proof of genuine family relationship
Health and character requirements
Financial and sponsorship obligations
Identity and passport documents
Applicants need valid identification documents to establish identity and citizenship.
Proof of family relationship
Evidence showing the claimed relationship, such as marriage certificates, birth records, or other supporting documents, is required.
Sponsorship documents
Sponsors need to provide documentation confirming their eligibility and capacity to support the application.
Financial and supporting evidence
Applicants and sponsors may need to provide financial documents and other supporting evidence relevant to the visa criteria.
Health and character documentation
Medical exams and police clearances are typically required to meet visa conditions.
We start with a detailed assessment of your circumstances, including eligibility, visa options, and any potential complexities.
A comprehensive application is prepared, making sure every legal requirement is addressed and the supporting evidence is properly compiled.
The application is lodged with the Department of Home Affairs for assessment.
Throughout the process, we stay on top of communication with the Department and provide legal support to respond to requests and manage progress.
Family visa applications often carry complex legal and evidentiary demands. Working with a migration lawyer helps make sure your application is prepared in line with current law and backed by the right documentation.
Legal guidance also helps catch problems early, strengthens your application, and presents your case clearly to decision-makers, which matters in particular for complex family arrangements or where there have been prior visa issues. Australian Migration Lawyers offers tailored advice and ongoing support for family visa applications. Contact our Adelaide team to discuss your circumstances.
Government visa application fees
As of 1 July 2026, indicative base application charges include:
Child Visa (101/802) and Adoption Visa (102): $4,040 primary applicant, $2,020 additional applicant aged 18 or over, $1,015 additional applicant under 18. A Subclass 802 applicant who is state government supported pays no fee.
Remaining Relative (115/835) and Aged Dependent Relative (114/838) visas: $6,600 primary applicant, $3,300 additional applicant 18 or over, $1,655 additional applicant under 18.
Carer visa (116/836): $2,720 primary applicant, $1,365 additional applicant 18 or over, $680 additional applicant under 18.
Sponsorship and financial obligations
Sponsors may need to meet certain financial commitments as part of the visa process.
Legal and professional service fees
Professional fees depend on how complex the application is and how much legal assistance it needs.
Health checks and documentation costs
Applicants may incur costs for medical exams, police clearances, and other supporting documentation.
Factors affecting visa processing times
Processing times can vary depending on the visa subclass, how complete the application is, and Departmental priorities at the time.
Typical processing timelines for family visas
Published indicative timelines exist, but actual processing can differ a lot depending on individual circumstances and demand. Remaining relative visa processing time, in particular, tends to be lengthy, given the limited number of places available each year, so it's worth discussing realistic expectations with your migration lawyer rather than relying on a general estimate.
Insufficient relationship evidence
Applications can be refused where the evidence doesn't adequately establish a genuine family relationship.
Incomplete or incorrect documentation
Errors or gaps in the application can lead to delays or refusal.
Sponsorship eligibility issues
Not meeting sponsorship requirements can affect the outcome of the application.
Health or character concerns
Not meeting Australia's health or character requirements, including failing required medical assessments or police clearances, can affect the outcome of the application.

Australia offers a range of family visas, including partner, parent, child, and other relative visas, along with family sponsored visas covering other family members such as siblings and dependent relatives, each with its own eligibility requirements.
Processing times vary depending on the visa subclass, how complex the application is, and Departmental priorities.
Eligible Australian citizens and permanent residents may be able to sponsor certain family members, including relatives such as siblings and other dependants, subject to meeting legal requirements. Sponsors need to submit the appropriate forms and documentation as part of the application.
Required documents typically include identity records, proof of relationship, sponsorship documentation, and supporting evidence relevant to the visa criteria. A birth certificate is commonly needed to establish a child's relationship with their parent and confirm identity, and character checks are usually required for applicants over a certain age.
Depending on your circumstances, there may be options to seek a review of the decision or look at an alternative visa pathway. Legal advice can help work out the right next step.
