要点总结

  • The Partner Visa (Subclass 309) is Australia’s offshore partner visa pathway, requiring the applicant to be outside Australia at the time of lodgement and at the time of grant.
  • According to the Department of Home Affairs’ Global Visa Processing Times guide, 50% of Subclass 309 applications are currently processed within 21 months and 90% within 32 months.
  • The most common cause of delay is lodging an incomplete or poorly evidenced application that requires follow-up from the Department of Home Affairs.
  • The Department assesses relationships across four categories: financial aspects, the nature of the household, social aspects, and the nature of the commitment.
  • A decision-ready application submitted with all supporting documents, health assessments, and character clearances at lodgement gives the strongest prospect of a timely outcome.
  • If your de facto relationship is under 12 months, registration under an Australian state or territory relationship register may allow you to proceed without meeting the standard cohabitation period.

What Is the Subclass 309 Partner Visa?

The Partner (Provisional) Visa (Subclass 309) is Australia’s offshore partner visa pathway. It allows the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to apply from outside Australia to live, work, and study in Australia. The Subclass 309 is the temporary first stage of a two-stage process; the second stage is the Partner Visa (Subclass 100), which grants permanent residency and is assessed approximately two years after the original application is lodged.

Both stages are lodged as a single combined application. The applicant must be outside Australia when the application is lodged and outside Australia when the Subclass 309 visa is granted. Applicants already in Australia are not eligible for this pathway; the onshore equivalent is the Partner Visa (Subclass 820/801).

Processing times for the Subclass 309 are lengthy. According to the Department of Home Affairs’ Global Visa Processing Times guide, 50% of applications are currently processed within 21 months and 90% within 32 months. The Department continues to prioritise aged, compassionate and compelling applications, which affects current processing times across the queue. With timelines of this length, the quality of the application at lodgement is the primary variable within an applicant’s control.

The Four Categories the Department Assesses

Before covering the mistakes that cause delays, it is worth understanding how the Department of Home Affairs assesses a partner visa application. Under Regulation 1.15A of the Migration Regulations 1994, the Department evaluates whether a relationship is genuine and continuing by examining evidence across four categories.

The first is the financial aspects of the relationship, including joint bank accounts, shared financial responsibilities, and evidence of mutual financial support. The second is the nature of the household, covering domestic arrangements, shared accommodation history, and evidence of joint household responsibilities. The third is the social aspects of the relationship, including recognition of the relationship by family and friends, joint social activities, and how the couple presents publicly. The fourth is the nature of the commitment, including the length of the relationship, future plans, and evidence that both parties are committed to a shared life together.

A strong 309 partner visa application addresses all four categories with documented, specific evidence. An application that is thin or silent in any one category gives the Department reason to pause or raise further enquiries, which directly extends processing time.

Mistake 1 — Lodging Before Health and Character Documents Are Ready

One of the most direct causes of delay is lodging the application before health assessments and police clearances are complete. The Department of Home Affairs cannot finalise a Subclass 309 application without health and character documents for both the primary applicant and any secondary applicants included.

Health assessments are arranged through an approved panel physician and must be linked to the application via a Health Identifier (HAP ID). Police clearances are required from Australia and from every country where the applicant has lived for 12 months or more in the last 10 years. These take time to obtain, particularly from countries where official processing delays are common.

Lodging first and obtaining these documents afterwards is a common approach that extends processing considerably. A case officer who picks up the file and finds outstanding health or character requirements cannot progress the matter. Completing these requirements before or at lodgement removes a significant source of delay.

Mistake 2 — Thin or Missing Evidence in One of the Four Categories

Applications that address some relationship categories well but leave others underdeveloped are among the most common files to attract requests for further information from the Department of Home Affairs. This is particularly common with the financial category in long-distance relationships, where couples assume that the absence of joint bank accounts means they cannot satisfy this pillar.

Financial evidence does not require joint accounts. Remittances, shared travel costs, joint subscriptions, evidence of financial planning correspondence, and records of financial support during periods of separation all count. Similarly, the household category does not require continuous cohabitation; evidence of shared accommodation during visits, communications confirming domestic arrangements, and records of living together at any point in the relationship are all relevant.

Every category must be addressed. A file that is strong in three categories but silent in the fourth will draw scrutiny and delay a decision.

Mistake 3 — Statutory Declarations That Read as Generic Templates

Statutory declarations from the applicant and sponsor are a core part of every partner visa subclass 309 application. They are also one of the most common points of weakness. Declarations that are brief, generic, or nearly identical between the applicant and sponsor raise authenticity concerns and invite closer scrutiny of the file.

A convincing statutory declaration is written in the author’s own voice and addresses the relationship chronologically: how the couple met, how the relationship developed, key milestones, how they have managed periods of separation, their communication patterns, and their future plans together. The two declarations should be consistent on the facts but distinct in voice and detail. A case officer reading both should recognise two separate people describing the same relationship, not one document carrying two signatures.

Witness declarations under Form 888 carry the same risk. Where multiple witnesses use the same structure and similar language, authenticity concerns arise under the provisions of the Migration Act 1958 dealing with false or misleading information. Each witness should describe their own relationship with the couple and provide observations specific to their own experience.

Mistake 4 — Inconsistent Dates and Details Across the Application

The relationship start date and key milestones stated in Form 47SP must align precisely with the statutory declarations, travel records, social media history, and any other evidence in the file. Discrepancies between these sources, even minor ones, draw scrutiny and can trigger a request for further information or, in more serious cases, concerns under the provisions of the Migration Act 1958 relating to false or misleading information.

Common inconsistencies include differing accounts of when the couple first met, different descriptions of when cohabitation began, and travel records that do not match the relationship history described in the declarations. Before lodging a subclass 309 partner visa application, the entire file should be reviewed for internal consistency across all documents.

Mistake 5 — Failing to Disclose Known Complications

Partner visa applications that involve a known complication, such as a prior visa refusal, a sponsor with a previous partner sponsorship, a sponsor’s character history, or gaps in the relationship timeline, are frequently delayed when those matters are not addressed proactively in the application.

Disclosure requirements under the Migration Act 1958 mean that material information about the sponsor and applicant must be provided to the Department of Home Affairs. Omitting or understating a known issue does not remove it from consideration; the Department’s own checks will surface it. When a complication is addressed upfront with a clear explanation and supporting material, the case officer can resolve the question without pausing the file. When it is not, a request for further information or a natural justice letter follows, adding months to the processing time.

A prior visa refusal in a different relationship is not automatically a barrier to a Subclass 309 grant in a new genuine relationship, but it must be disclosed and addressed directly.

Mistake 6 — Not Meeting the De Facto Cohabitation Requirement

De facto partner applicants must generally demonstrate 12 months of cohabitation immediately before lodging the application under the Migration Regulations 1994. Applications lodged before this requirement is met will be refused.

An exception applies where the relationship is registered under an Australian state or territory relationship register. In Victoria, registration under the Relationships Act 2008 (Vic) is recognised by the Department of Home Affairs as conclusive evidence of a de facto relationship and removes the 12-month cohabitation requirement. Couples who have not yet reached 12 months of cohabitation should seek legal advice before lodging, as options may be available depending on their specific circumstances.

Attempting to work around this requirement by misrepresenting the commencement date of cohabitation carries serious risk. Inconsistencies in the evidence will surface during assessment, and a finding of false or misleading information under the Migration Act 1958 carries a five-year application exclusion period.

Mistake 7 — Not Responding Promptly to Requests for Further Information

Even a well-prepared application may attract a request for further information from the Department of Home Affairs under section 56 of the Migration Act 1958. These requests come with a specified deadline, typically 28 days. Failing to respond within that deadline means the Department will make a decision on the information already before it, which in most cases results in refusal.

Responding to a section 56 request promptly and completely is essential. A partial response that addresses some but not all of the Department’s queries will often attract a follow-up request, extending the delay further. Where a request raises questions about the genuineness of the relationship or the completeness of the evidence, legal advice before responding can materially affect the outcome.

Managing the Offshore Period

Applicants who wish to visit Australia while their Subclass 309 application is being processed may do so on a valid visitor visa, but most visitor visas carry a no-work condition (Condition 8101). Working in breach of a visitor visa condition is a character matter that can affect the Subclass 309 decision.

Applicants who intend to visit Australia during processing should obtain advice about their travel conditions before departing. Maintaining an accurate record of location during processing is also important; the Department expects the applicant to be outside Australia at the time of grant, and any misrepresentation in this regard will delay or jeopardise the application.
