The ART replaced the former Administrative Appeals Tribunal (AAT), which many applicants and older guides still refer to by name, particularly in relation to matters lodged before the changeover. An ART review is a merits review, not an appeal in the traditional sense. Rather than checking whether the original decision maker made a legal error, the Tribunal reconsiders the facts, the law, and the relevant Department policy afresh, and reaches its own view of the correct decision. This is a meaningful distinction from judicial review, which is limited to identifying legal error and does not involve the court substituting its own decision for the Department's.
Not every decision can be reviewed. Reviewable decisions are set out in Part 5 and Part 5A of the Migration Act 1958, and whether a particular refusal or cancellation qualifies depends on the visa subclass and, in some cases, the applicant's location at the time of the decision. The refusal or cancellation notice from the Department should state whether review rights exist, though this information is not always accurate, and confirming it independently is a sensible first step before relying on it.
The steps to lodge an ART review follow a similar sequence for most matters, though the detail differs depending on whether the decision is a refusal or a cancellation.
1. Confirm the decision is reviewable
Check that your refusal or cancellation falls within the reviewable decisions set out in Part 5 or Part 5A of the Migration Act 1958.
2. Identify the correct time limit
Confirm the exact deadline that applies to your decision type and location, since this varies and cannot be extended once missed.
3. Lodge the application with the ART
Submit the application together with the prescribed fee, within the time limit identified above.
4. Prepare the case
Gather evidence and address the specific criteria the Department found were not satisfied. This step generally determines the outcome.
5. Prepare written submissions
Set out the legal and factual argument for why the original decision should not stand, ahead of the hearing.
6. Attend the hearing
Hearings can take place in person, by video, or by telephone. In some matters, the Tribunal may decide the review on the papers without an oral hearing at all. An applicant can attend and represent themselves, though a representative may also appear on their behalf.
An applicant is not required to have a lawyer attend the hearing, and self-representation is permitted. That said, self-representation carries real practical risk in this setting specifically. The hearing is where the Tribunal member tests the evidence and asks questions about exactly the criteria the Department found were not satisfied. An applicant representing themselves needs to respond to legal and factual points in real time, in a formal setting, often in a second language, without the benefit of having anticipated the specific questions in advance. This is different from simply attending and telling your story. A lawyer who regularly appears before the ART can anticipate the likely lines of questioning, respond to legal points as they arise, and ensure the submission already made in writing is reinforced rather than undermined by an answer given under pressure.

The ART review lodgement time limit is one of the most consequential details in the entire process, because the Tribunal generally has no power to extend it. For most migration review decisions, the time limit for an applicant in Australia is typically 21 to 28 days from the date the decision is taken to have been notified, depending on the subclass involved. Character-related refusals or cancellations, and decisions made while an applicant is in immigration detention, generally carry a much shorter time limit, in some cases as little as a matter of days.
Because the way a decision is notified affects when the clock starts, and because the correct time limit depends on which provision of the Migration Act applies to the specific decision, it is worth confirming the applicable deadline directly rather than relying on a general rule of thumb.
An ART review for visa refusal and an ART review for visa cancellation follow a broadly similar process before the Tribunal, but they differ in when they arise and what is practically at stake.
Appealing a refused visa decision and appealing a cancellation decision both require addressing the specific criteria the Department relied on, but a cancellation matter often also needs a more detailed factual and legal case to explain why cancellation should not have occurred in the first place.
The Tribunal has four possible outcomes available to it:
Each of these ART review decision outcomes has a different practical effect. A set-aside or a favourable remittal generally moves an applicant toward having the visa granted, while an affirmed decision means the refusal or cancellation stands and the applicant needs to consider what other options remain available.
What happens after an ART review depends on the outcome. Where a decision is affirmed, options may include judicial review in the Federal Circuit and Family Court of Australia, though this is limited to identifying a legal error in how the Tribunal reached its decision, not simply disagreeing with the outcome. In limited circumstances, an applicant may also seek Ministerial Intervention, which is entirely discretionary and not subject to review itself. Throughout the review process, an applicant may be eligible for a bridging visa, which can allow continued lawful stay in Australia while the matter is on foot, depending on individual circumstances and the type of decision under review.
