People seeking refuge in Australia are known as refugees and can seek a Protection Visa (866). A refugee is a person who is:

  • Outside of their country of nationality, or home country, and
  • Due to a “well-founded fear of persecution”, is unable or unwilling to return to their home country or seek protection by their home country.

Australia also grants this visa to people who, if returned to their home country, may suffer significant harm, including: 

  • Arbitrary deprivation of life
  • The death penalty 
  • Torture
  • Cruel or inhumane treatment or punishment
  • Degrading treatment of punishment

Once you have this visa, you will be able to live, study and work in Australia indefinitely.

Protection visas - understand your eligibility

In Australia, visa requirements, laws and regulations continue to change regularly. The Protection Visa (866) has a range of eligibility requirements that need to be met.

Here are the eligibility requirements for a Protection Visa (866):

  • You must have arrived in Australia on a valid visa. 
  • You must not be an unauthorised maritime arrival. 
  • You must be a refugee or meet the complementary protection criteria. 
  • You must not have been refused previous visa applications or have dual nationality.
  • You must not have had a protection visa cancelled in another country. 
  • You must be able to identify yourself.
  • You cannot have held the following visas: 
  1. Temporary Protection Visa (785)
  2. Temporary Safe Haven Visa (449)
  3. Temporary (Humanitarian Concern) Visa (786)
  4. Safe Haven Enterprise Visa (790)
  • You must meet Australia’s security requirements for this visa. 
  • You must be in Australia when you apply for this visa.
  • You must meet the health and character requirements.
