What is an Administrative Review Tribunal (ART) Appeal?

An Administrative Review Tribunal (ART) appeal is a legal process that lets eligible applicants seek an independent review of certain visa decisions made by the Department of Home Affairs. The Tribunal reassesses the facts and the law to decide whether the original decision should be upheld or changed. The ART was established under the Administrative Review Tribunal Act 2024, and it replaced the former Administrative Appeals Tribunal (AAT) on 14 October 2024, taking over the AAT's migration and refugee caseload along with its other functions.

ART Appeal Process for Visa Decisions

1

Reviewing your visa refusal or cancellation decision

The process starts with a detailed review of the decision to identify the reasons for refusal or cancellation and assess your available review rights.

2

Lodging an appeal with the ART

An application for review, along with the ART filing fee, needs to be lodged within the prescribed time limits, meeting the ART's application lodgement requirements.

3

Case management and directions

Once lodged, the ART will generally issue case management directions setting out timeframes for evidence, submissions, and any conferences before the matter proceeds further.

4

Preparing legal submissions and supporting evidence

Comprehensive submissions and supporting documents are prepared to address the issues raised in the original decision.

5

Attending the tribunal hearing

Depending on the matter, applicants may attend an oral hearing, or in some cases the matter may proceed by paper review without a hearing, where the Tribunal considers the material on the file.

6

Tribunal decision and next steps

The Tribunal will issue an ART Member decision, which may affirm, set aside, or remit the case, depending on the circumstances.

ART Appeal Deadlines and Time Limits

Time limits to lodge an ART appeal

Strict time limits apply to lodging an appeal, and these vary depending on the type of decision and the applicant's circumstances. Commonly cited deadlines include a 21-day window for many onshore refusals, a 28-day window for most other onshore migration and protection decisions, a shorter 7-day deadline for applicants in immigration detention, and a 9-day deadline for character-related (Section 501) decisions made within the migration zone. Your decision letter will state the exact deadline that applies to your case, and it's worth confirming this immediately rather than relying on general figures.

What happens if you miss the deadline

Failing to lodge an appeal within the required timeframe can result in the loss of review rights, with very limited exceptions, since the ART generally has no power to extend these deadlines for migration and protection matters.

Factors affecting appeal timelines

How long an appeal takes can depend on case complexity, the availability of evidence, and the Tribunal's workload.

Documents Required for an ART Appeal

Visa refusal or cancellation notice

The original decision notice is essential to understand the reasons for refusal or cancellation.

Supporting evidence addressing refusal reasons

Applicants should provide evidence directly addressing the issues identified in the decision.

Personal statements and statutory declarations

Statements may be used to clarify circumstances and provide additional context to the Tribunal.

Additional documents strengthening your case

Further documentation may be needed to support claims and demonstrate eligibility.

What Happens During an ART Hearing?

How tribunal hearings are conducted

Hearings are typically conducted in a formal setting where the Tribunal reviews the evidence and considers submissions.

Questions asked during the hearing

The Tribunal may ask questions to clarify aspects of the application, evidence, or personal circumstances.

Role of migration lawyers during the hearing

Migration lawyers help by preparing clients, presenting legal arguments, and making sure procedural fairness is maintained throughout the hearing.

Possible Outcomes of an ART Appeal

Tribunal sets aside the Department's decision

The Tribunal may replace the original decision with a new outcome, which may be more favourable to the applicant.

Tribunal affirms the refusal decision

The Tribunal may agree with the Department's decision and uphold the refusal or cancellation.

Tribunal sends the case back for reconsideration

In some cases, the matter may be remitted to the Department for reconsideration in line with the Tribunal's findings.

What If Your ART Appeal Is Unsuccessful?

Judicial review in the Federal Circuit and Family Court

Applicants may have the option to seek judicial review where there's an arguable legal error in the Tribunal's decision.

Alternative visa pathways

Depending on individual circumstances, alternative visa options may be available.

Seeking further migration legal advice

Professional legal advice can help identify appropriate next steps following an unsuccessful appeal.

History of migration in Adelaide

Adelaide was founded in 1836 as a planned free settlement, attracting British and German migrants who shaped the city's early character and gave South Australia its distinctive reputation for religious tolerance and social reform. The post-World War II era brought significant waves of migrants from Italy, Greece, and Eastern Europe, many of whom settled in Adelaide's inner and western suburbs and contributed to the city's growing manufacturing and construction industries. From the 1970s onwards, Adelaide welcomed humanitarian entrants and skilled migrants from Vietnam, China, India, and the Philippines, communities that continue to grow today. South Australia now counts almost 430,000 overseas-born residents from more than 214 countries, speaking 248 languages, making Adelaide one of Australia's most quietly diverse cities with a rich and layered migration story. FAQs About ART Appeals Adelaide

It's an independent body that reviews certain decisions made by the Department of Home Affairs, established under the Administrative Review Tribunal Act 2024 to replace the former AAT.

Time limits vary depending on the type of decision and your circumstances, and strict deadlines apply, so it's worth checking your decision letter for the exact figure.

Timeframes vary depending on case complexity and the Tribunal's capacity, and appellants can expect the process to take anywhere from around a year to several years to be finalised.

In some cases, applicants may be granted a bridging visa that lets them remain in Australia during the appeal process.

It's not mandatory, but legal representation can help with preparing submissions, addressing legal issues, and presenting your case effectively.

If the ART decides to set aside a decision, it's replacing the original decision with a new one, which may be more favourable to the applicant, rather than simply sending the matter back unresolved.
